Can a release of lien be obtained if the original lienholder cannot be located?
I recently purchased a property and discovered that there is a lien against it from a previous owner's unpaid contractor. However, I have been unable to locate the original lienholder to request a release of lien. I need to know if it is possible to obtain a release of lien in this situation, and if so, what steps I should take to ensure the lien is cleared from the property's title.

You have several alternatives. Did your original title policy insure against liens? If so, I can work with the title company to have the lien removed. Second, if the lien is old, it may have already expired and can be removed as a matter of law. Third, there are procedures in every state to remove a lien if the lienholder cannot be located. Depending on the land and business, I'd consider making an LLC for asset protection reasons. Then you could have a trust as the member. If you need to get the property out of your estate, this will dictate what to do with the trust.

I recently entered into a land lease agreement to rent a plot of land for my business, with a term of 5 years. However, the landlord has informed me that they want to terminate the lease agreement before the agreed-upon term expires. I am concerned about my rights as a tenant and whether the landlord has the legal authority to terminate the lease prematurely.

Hi there, Generally, a landlord cannot unilaterally terminate a land lease agreement before the end of the agreed-upon term—especially if the lease is for a fixed period like 5 years—unless the lease specifically allows for early termination or you, as the tenant, have violated the lease terms. Here is what you need to know: Understanding Your Rights as a Tenant: Fixed-Term Leases Are Binding Contracts: A 5-year lease creates a legally enforceable agreement. Unless the lease contains an early termination clause, the landlord is bound to honor the full term. Landlord Cannot Terminate Without Cause: If you are in full compliance—paying rent on time and following the lease terms—the landlord typically has no legal authority to terminate the lease early without breaching the agreement. Review the Lease Terms: Carefully review your lease for: Termination clauses Conditions for default or breach Notice requirements These will determine what rights the landlord may—or may not—have. You May Be Entitled to Remedies: If the landlord attempts to terminate without proper grounds, you may be able to: Enforce the lease and stay on the property Seek damages for any losses you incur due to early termination File a legal action for breach of contract, if necessary Early Termination Negotiations (Optional): In some cases, parties can agree to a mutual termination with compensation, but this is entirely voluntary and should benefit both sides. If I am separating with someone I co-own a house with, not married, are there any repercussions to me moving out of the house before we have a signed agreement?
I bought a house with my boyfriend, we are now breaking up. We built the house and moved in in October 2022. It's too soon to sell and make money off of it. I am willing to move out, but I want the cash that I initially put into the house during settlement. We are attempting to come up with an agreement, which I would like an attorney to review before I sign.

Whether there are any repercussions depends upon the circumstances surrounding your purchase. For example, whether or not a mortgage exists can affect the situation. If you are on the mortgage, it would not matter what agreement you sign with your boyfriend, you are still on the hook for the mortgage unless you can negotiate with the lender to remove yourself from the mortgage. It may require your boyfriend to refinance. You are certainly making the right move by having an attorney review any agreement between you and your boyfriend. You just need to consider the third-party lender and how that may also affect you.

I'm in the process of purchasing a property and the seller and I have verbally agreed to the terms of the purchase. I'm concerned about the validity of the agreement and want to ensure that I am properly protected under the law. I am looking for clarification on whether an oral purchase agreement is legally binding.

Your question suggests a real estate purchase. Oral contracts for the sale or transfer of land are subject to the statute of frauds in most states. This requires such agreements to be in writing and signed by the parties to be enforceable. Although there are some limited exceptions, I recommend trying to get your verbal agreement memorialized in writing as soon as possible.
