I sold my house but was never paid

To avoid foreclosure, I spoke with a contractor to flip my house for me. He would pay my mortgage until it sold then pay it off and keep the profit. I walk away with the mortgage company paid, but I was fouled. He isn't paying the mortgage after I signed the contract. I'm concerned he will be able to sell it now himself without the mortgage company ever being paid.

There are many issues involved in this question. I would need to see the original deed and mortgage on your house plus the contract you signed with the contractor. The original mortgage almost certainly had an acceleration clause stating that if you sold the property, then the full mortgage becomes due. Going after the contractor might be possible but other avenues would more likely be the better route to keep your house from being foreclosed. Will also need to see if your contract gives ownership to the contractor or just the right to sell on your behalf. Lots of additional questions that need documents to give you your options.

Is it possible to negotiate the terms of a royalty agreement for my creative work?

I am an independent artist who recently received an offer from a publishing company to use my artwork for merchandising purposes. They have provided me with a royalty agreement, but I am unsure about some of the terms and whether they are fair. I believe that my artwork has significant commercial potential, and I want to ensure that I am adequately compensated for its use. Therefore, I am seeking legal advice on whether it is possible to negotiate the terms of the royalty agreement to better protect my interests and maximize my potential earnings.

I do not consider myself an expert in this area, but a royalty agreement is a type of contract, and there are several things for you to know about contracts in general. In no particular order: 1. The terms of any contract can be negotiated; 2. Any time a company hands someone any type of contract the company wrote, almost all terms will favor the company and not the other party signing the contract; and 3. Any time one is considering signing a contract for any type of real value, it's best to have a contracts attorney review the contract, advise you, and help you negotiate terms that are more favorable to you. (I'm not trying to push work for attorneys - I'm suggesting this to protect you). If you were signing a contract to have a kid mow your lawn once a week, you typically would not need an attorney - but for something like this, you were wise to ask questions. You can find contracts attorneys through wsba.org, and looking through the Directory under "contracts" or of course through ContractsCounsel.com. Whatever attorney you hire for a consultation, review, advice, or negotiation for something so important, please be sure to look into the attorney's reviews, education, experience, etc, just like you would for any other "expensive employee." Hello! The most significant risk is missing or being late on a payment, which could potentially breach the purchase agreement. Another risk is that the current owner usurps the deal or attempts to sell the property to someone else. At least, these are some of the practical risks. An attorney should review the written Lease Purchase agreement to outline the potential risks and recommend possible edits.

Do you work for a commission of what is recovered?

We purchased a home with an enclosed sun room. This room was not permitted and is not up to code, therefor has to be torn down and rebuilt at a cost of $25,000. I feel this should have been disclosed by the seller and home inspector we hired. Do we have any recourse?
