If you break a lease can a landlord add crazy charges without an agreement?
I signed a lease 9/11 and tried to break it 9/13. Landlord charged me 60 days and did not provide an early termination agreement

Is there an early termination in the original document that you signed? Typically, you can withdraw from an agreement with minimal fees but it all depends on what your contract states. If you contract does not have any early termination language, you will need a real estate attorney in your state to advise on the law of your state and how to handle. All the best Donya Gordon

Should I get a cease and desist letter?
I have an ex partner who has become out of nowhere disgruntled and left an angry comment on my business page that was something offensive to my client and that I disagreed with. It's been a few weeks of silence and Wednesday they texted me a very angry message about how removing their comment was an unethical business practice and a lot of other accusations about my being cruel to animals, have them in unsafe conditions or that I am the cause of my fosters kittens death, as well as leaving a review on my business page stating the same things. All of these statements are untrue. It's not uncommon to loose kittens when you foster sick neonatal kittens. As far as the conditions my cats are in, I can prove with photos and videos that were sent to this person in private messages were not bad but actually full of enriching toys, supplies, clean and I have people whom regularly are in my home that witness this. I'm unsure whether or not they're going to escalate since Facebook took the review down but this person has a long history of mental illness and I'm afraid of how a bad review like they gave me being posted and not getting removed would do for my business.

If these comments are made on the Facebook platform, I would advise you to use their dispute resolution procedures. I also suggest you respond to any future negative comments from your ex-partner by contradicting the negative statements. If the comments continue to excess and you are unable to resolve through Facebook procedures, then a cease and desist may be warranted. That also may not stop the comments so you may need to seek other legal remedies.

Is my non-compete enforceable?
If a small company made you a verbal offer of salary, car, health insurance assistance then after you signed the employment agreement, including non compete, made excuses and never made good on the car and the insurance assistance, is the non compete enforceable. I singed based on promises of a partnership and those additional perks since they didn't provide any other benefits. I turned down other opportunities because of the partnership potential and brought my own equipment and opportunity. Now after providing new business opportunity I asked for some protection in writing regarding partnership in the new technology, mainly developed by me and partly carried over from previous experience. Instead of getting the promised protection in writing I got fired. I know that it isn't in writing because of excuses but I also know they would never lie under oath. They are many things but they wouldn't do that for very religeous reasons. The non compete is onerous and those perks were to sweeten the deal so I would sign. I even met with their attorney to complain about it before signing based on their promises which then never materialized and were not provided in writing.

I suggest you seek an employment attorney in your area to discuss. If they are so religious, what happened to you should not have. An agreement for the partnership need to be in writing to be enforceable. If you signed an employment agreement, then you should have signed something when you were leaving. An attorney would need to review both documents to advise you going forward. All the best

Software agreement and dispute escalation?
I am a software developer who recently entered into a software agreement with a client. We have been having some disputes regarding the agreement, but we have been unable to come to a satisfactory resolution. I am now looking for advice on how to best resolve the dispute and how to protect my rights under the software agreement.

The first step to resolving a dispute is to look at what the software agreement says. The agreement may have terms or conditions in there that discuss what happens when there is a dispute. Without seeing the agreement it is difficult to say what you could do to best protect your rights and resolve the dispute.

Can I create a contract that bars any form of dispute resolution (Jury trial and Mediation/Arbitration) if a client fails to dispute an invoice within 7 days of receipt.
I own a growing security guard firm and all my clients sign a service contract before we provide services. In order to reduce the stress of collecting from a slow playing client, I want to create a new contract that makes it impossible to dispute an invoice after 7 days of receipt.

While you may create a contract without dispute resolution, the issue is whether it would be enforceable by any court. Seeing that a contract is between two parties and disputes arise, by barring any resolution, it would essentially not afford a party an opportunity to be heard.
