Can a landlord terminate an office space lease before the agreed-upon term ends?
I recently signed a lease agreement for office space for my small business, but due to unforeseen circumstances, I may need to relocate sooner than anticipated. I want to know if the landlord has the right to terminate the lease before the agreed-upon term ends, and if so, what are the potential consequences for me as the tenant? I am concerned about any financial penalties or obligations that may arise from terminating the lease early.

A landlord could agree to terminate the lease if a tenant requests it or can modify a lease to allow for an option for a tenant to vacate the premises at an earlier date. If a tenant wants to vacate the premises on an earlier date than the lease end date, either the landlord would have to agree to the earlier termination date or the tenant could be found in breach of contract. If you are considering early termination, it's advisable to communicate with the landlord to explore possible solutions, such as subleasing, assigning the lease, or negotiating a modification to the lease agreement. I understand that I will need the landlord's permission to make these changes, but I am unsure of what the landlord's policy is regarding tenant alterations and what the legal implications of making such changes might be. I am looking for clarification on the tenant's rights and obligations when making alterations to a commercial lease agreement.

Hello! There should be an alterations clause in your lease that speaks to what is or isn't allowed in your space. Your safest bet is to have your landlord review and sign a letter of consent for more substantial improvements (beyond paint, mounting items, etc.)

Can the tenant make changes to the property's signage?
I am looking to rent a commercial property for my business and have recently come across a potential property. The lease agreement states that the tenant is not allowed to make any changes to the property's signage. I am interested in understanding if there are any exceptions to this rule and if the tenant can make changes to the signage.

Standard commercial lease template includes language about the nature and extent of modifications tenants can make to a property. In this instance, there's no legal or regulatory exception that is going to protect you from a restriction in the lease. Your best bet is to negotiate directly with the landlord for a modification to the lease terms.

Can a landlord increase the rent on a commercial building lease without providing notice or justification?
I have been leasing a commercial building for my business for the past three years, and recently, my landlord informed me of a significant increase in the monthly rent. However, there was no prior notice or explanation given for this sudden increase, and I am concerned about the legality of such action. I want to know if the landlord has the right to raise the rent without providing any notice or justification, and what options I have to address this issue if it is indeed unfair or unlawful.

In a vacuum, a landlord should not have a unilateral right to raise rent. A landlord may have the right to raise rents periodically, pursuant to the lease document. It is very much a contract issue. It depends on the exact wording of the lease agreement. The lease agreement will also detail the requirements for valid notification concerning the agreement. My experience over 25 years of practice is that most building lease agreements expressly provide for base rent to increase each year. A court will enforce most reasonable rental, escalation, clauses, and lease agreements. If there is no obvious language in the lease, the question becomes whether rental increase is implied under the wording of the document or an amendment to it. At the risk of being repetitive, it depends on what the lease says, if anything at all.
