Hello! I hope you are well! If X is contesting a defective or invalid deed, and the quitclaim deed has been recorded for at least five years, then the deed will be considered valid. Under Oklahoma law, an instrument (in your case, the quitclaim deed) that has not been acknowledged or which contains a defective acknowledgment shall be considered valid notwithstanding such omission or defect, and shall not be deemed to impair marketability, provided such instrument has been recorded for a period of not less than five (5) years. 16 O.S. §§ 27a & 39a. In Ohio, a deed can be corrected either by re-recording the prior deed with corrections made directly on it, or by recording a new deed, called corrective deed. Correcting the legal description can all be achieved through a corrective deed.

A quit claim deed is effective upon execution so long as the deed is dated as of the date of signature. Execution means that the deed is signed, in front of a witness and a notary. The witness and notary must also sign the deed. Finally, the deed must be recorded. Can a seller back out of a Lease Purchase Agreement without providing a reason?

I entered into a Lease Purchase Agreement with a seller for a property, where I agreed to lease the property for a certain period with the option to purchase it at the end of the lease term. However, the seller recently informed me that they have decided not to proceed with the agreement and are backing out, without providing any specific reason for their decision. I had already invested time and money into preparing for the purchase, and I am now concerned about my rights and options in this situation. Can the seller legally back out of the Lease Purchase Agreement without giving a reason, and what recourse do I have?

Quite simply, the answer depends on exactly what the LPA States either party will or will not do. Ordinarily termination or cancellation rights are expressly spelled out in contracts. This is why it is so important to have an attorney work on your documents rather than just using canned documents available on the Internet.
