Can I terminate a parking agreement if the landlord has breached the terms?
I entered into a parking agreement with my landlord, which stated that I would have exclusive access to a designated parking spot for a monthly fee. However, the landlord has repeatedly allowed other tenants to use my spot, making it unavailable to me on several occasions. I have brought this issue to the landlord's attention multiple times, but they have failed to rectify the situation. Can I terminate the parking agreement due to the landlord's breach of the terms?

What's personal leave in an employment contract?
I have recently been offered a job, and the employment contract I have been provided with states that I am entitled to personal leave. I am not sure what this is, or what it entitles me to. I would like to know what rights and responsibilities I have regarding personal leave, and what the employer's expectations are of me with regards to this leave.

Personal leave sometimes replaces vacation and sick time. Some employers just give employees time off for whatever reason the employee chooses. To know more about the rights and responsibilities, you should speak to HR at your new employer who will help you with the employer's expectations and your rights under the leave provision in your contract. Also, look at your contract as it may provide insight as to how to implement the leave. When in doubt, speak to HR. Thanks.

Catering Services Agreement

Is it legal for a catering company to charge a cancellation fee if an event is cancelled due to unforeseen circumstances beyond the client's control?
I recently signed a Catering Services Agreement with a catering company for my upcoming wedding. Unfortunately, due to the ongoing pandemic, our wedding venue unexpectedly closed and we had to cancel our event. The catering company is now insisting on charging us a hefty cancellation fee, even though the cancellation was completely beyond our control. I want to know if it is legal for them to do so and if there are any grounds for disputing this fee.

The short answer is: you’re probably liable for the fee. The longer answer is: it depends on a lot of variables. First, what does your agreement with the catering company say? Chances are, the catering company says that this type of thing isn’t their fault, and they held the dates for you. So the fee is due. Next, let’s start by acknowledging that it’s 2024 and not 2020. This is important because the timing is possibly important. If the venue closed during the pandemic, and all of this happened DURING the pandemic, you might have a force majeure argument. But if the venue closed in 2020 and the wedding was in 2024… and you failed to find a new venue in that time, then the fee is probably warranted. But overall, without more specifics, the answer is not determinable.

Can a Release and Waiver Agreement protect me from liability if someone gets injured while participating in an activity I organized?
I recently organized a charity event where participants engage in physically demanding activities such as obstacle courses and sports. I want to ensure that I am not held liable for any injuries that may occur during the event, so I am considering having participants sign a Release and Waiver Agreement. However, I am unsure if this agreement would actually protect me from potential legal claims and if there are any specific requirements or limitations I should be aware of when drafting the agreement.

First, if a participant is under 18, their parent or legal guardian must sign for them. Second, all these types of releases/waivers do is slow people down or discourage them from suing, but a good attorney can get around most of these (especially ones you buy off the internet). You should, at a minimum, make a good effort to ensure that all activities are as safe as possible, and also make sure you, your Board members, staff, and the organization are covered by solid insurance. I'm not trying to discourage you - I just want you to be very careful.

The difference between Maintenance and Warranty on an RV
We have a contract with a couple that we are leasing to own/rent to own a fifth wheel camper. In the contract it states that we are responsible for all maintenance for the term of the contract. My definition of maintenance is repairs like flooring, hinges, paint, etc. Things we can fix our self's. The issue is the RV has electrical issues, AC going out, Awning separating from RV. These issues require a dealer to fix. Way beyond what we can do. I need to know how to proceed?

I'm an Oklahoma attorney and not an Idaho attorney, so I am simply providing information about the general theory of contracts. For a more detailed response, you need to talk to an attorney in the place where the contract states for its choice of law. If your contract does not state a choice of law, it is possible the place where you live is not actually the law that applies to the contract. The law of the place where the buyers are located might apply. Typically, the words in a contract are to be interpreted in their usual and customary way and not in any technical way, unless the contract indicates otherwise. So, the dictionary meaning of "maintenance" may well be applied. I see two definitions in Merriam-Webster, both of which are not helpful to you because they are broad, not distinguishing between "maintenance" stuff like replacing brake shoes in a trailer's electric drum brake system and fixing or replacing broken things like an A/C unit that simply died after running non-stop during a heat wave. There may be some case law on this in the correct jurisdiction. Your really need to talk to a local attorney and show them the contract you have.
