When to sign a purchase and sale agreement?
I am in the process of purchasing a property and need to know when I should sign the purchase and sale agreement. I have been given an offer from the seller and have been told that I need to sign the agreement in order to move forward with the purchase. I am concerned about signing the agreement too soon and have questions about the timing and what risks I may be taking if I sign before I am sure I am ready.

If you are not ready to buy a property, it is only fair not to waste sellers’ time who are trying to sell their property. If, however, you are ready to buy a property but is concerned about unforeseeable risks, you can mitigate or eliminate your risks by spelling out contingencies in your Purchase and Sales Agreement. If the conditions or contingencies are not met, you do not have to go through with the deal.

Are there cancellation fees in purchase agreements?
I am currently in the process of purchasing a home and I have been presented with a purchase agreement. I was wondering if there are any cancellation fees included in the agreement, as I would like to make sure that I am aware of all the terms and potential costs associated with this purchase. I want to make sure that I am fully informed before I make a final decision.

Hello! I understand you are entering into a Purchase Agreement and want to know whether there are any cancellation fees. First, you would read the agreement to see if there is any mention of termination/cancellation fees such as the loss of the down payment if the buyer attempt to terminate the contract. But, generally, the agreement is binding contract. So, if a buyer attempts to cancel the contract, it could be considered a breach of contract. In that situation, the seller can claim damages, which usually results in a loss of the down payment but also could lead to other monetary claims or a claim to attempt to force the buyer to fulfill the purchase (general called a specific performance claim). Separately, in most cases, if the buyer's ability to purchase the property is dependent on getting a secured loan, usually there would be no cancellation or damage claim and the buyer would have the right to the return of the downpayment (this should be outlined in the contract and is usually referred to as a contingency clause). Can you purchase or refinance under a land contract?
I’ve been living here for 2 years. Currently have been working with my credit union and they are having a terrible time trying to understand the legalities of my land contract first off, and secondly they just don’t seem to know what they are doing. It’s been over 8 months, 4 different loan officers and I’m once again waiting for someone else to help finish this thing out. It’s only $60,000 with a $120,000 appraisal. So, as of now I am stuck paying 2.5x monthly under this land contract than I was promised would be an easy mortgage process. So any guidance in the right direction would be very helpful. It’s a New York home. 20 yr fixed, no balloon, with a (brace yourself) 12% apr. HELP ME PLEASE! One month I’m being told to authorize a credit check for a first time homebuyer grant method of mortgaging this property. The next it’s authorizing it for a refinance. I do have earnest money deposits for over $3,000 and another $3000 paid towards principal under this land contract also.

What are the legal implications of including an 'as-is' clause in a Property Sale Agreement?
I am in the process of selling a property, and I am considering including an 'as-is' clause in the Sale Agreement to protect myself from any potential liability for defects or issues with the property that may arise after the sale is complete. However, I am unsure of the legal implications of such a clause and whether it would truly absolve me of any responsibility. I would like to understand the potential risks and benefits of including this clause from a legal perspective before finalizing the agreement.

Hello and thank you for the opportunity to respond to this very important question. First, an "as is" clause in a Property Sale Agreement shifts the risk to the buyer. The burden of due diligence is shifted to the buyer and the property is being sold in its current condition, with no warranties or representations about the property's condition. In this way, the seller's liability is limited, as the seller is generally not liable for defects, even hidden ones, that the buyer could have discovered through a reasonable inspection. However, the seller's limited liability does not apply if the seller actively conceals a defect. Also, in Ohio, when selling "as is", the seller still has a duty to disclose, and not fraudulently misrepresent, known material defects. Failing to do so can lead to breach of contract, fraud claims, rescission of sale, and potential damages. Ultimately, when property is sold "as is", the buyer is expected to conduct inspections and investigations and negotiate repair terms or price reductions. Further, selling "as is" may affect the ability to finance the sale and/or insure the property, depending on the condition of the property. It is also important to note that courts tend to scrutinize the exact wording of the "as is" clause, and a broad, well-drafted clause will offer stronger protection to the seller. Trying to sell home. My title company having issue settling the debt. Title company contact loan to payoff, but no record of my property was found. Only past owner current home is on the loan. Quit Deed was done 2012. In 2015 past owner loan was passed to a different company who record in Florida my parcel number. So basically I can't pay loan off because my home is not attached to her loan. I still can't clear title because lien was recorded 2015 in Fl court house, but The past owner was no longer on deed. Looking to hire a lawyer to clear title, so I can sell my home.

This sounds complicated enough that you need a lawyer to get involved. Do you have a title insurance "owner's policy"? If so, that might get you a free lawyer (I can't tell from the facts you presented whether that will work). Also, you've tagged this question as a Virginia question, but you mention the lien being recorded in Florida. You need an experienced lawyer in the jurisdiction in which the property is located. If the house is in Virginia, you need a Virginia lawyer; if in Florida, you need a Florida lawyer. If it's a lien on Virginia property from a Florida judgment, then you need a Virginia lawyer, because that's where the property is located.
