Usually, these matters are relatively uncomplicated, however, at times they can be more complex. Can a grantor of a filed quit claim deed sell a home without the grantees signature, or consent?
Parent signed quit claim deed over to son and it has been filed. Parent is now threatening to sell property and not give any proceeds to son who is grantee on quit claim deed. Is this even possible, legally?

The quick answer is likely no. If someone has executed and filed a quitclaim deed, they have no interest left to sell. Any buyer is going to review title to the property and not accept deed from the parent.

Can a Deed of Trust be modified without the consent of all parties involved?
I recently purchased a property with the help of a mortgage loan, and a Deed of Trust was executed to secure the loan. However, I have come across some financial difficulties and am considering refinancing the mortgage to lower my monthly payments. I have been informed that the terms of the Deed of Trust may need to be modified in order for the refinancing to take place, but I am unsure whether all parties involved, including the lender and the trustee, need to provide their consent for such modifications to be made. Can a Deed of Trust be modified without the consent of all parties involved, or do I need to obtain their approval before proceeding with refinancing?

You must have their consent. In the general/miscellaneous provisions toward the bottom of the DOT, you should see a standard provision, stating that no amendment to the deed of trust will be valid unless evidenced by a fully executed written agreement.

I am in the process of purchasing a property and am in need of a Purchase and Sale Agreement. I am unclear on who typically drafts the agreement and am looking for advice from a lawyer. I understand that the agreement should be tailored to my specific needs and am looking for guidance on how to best proceed.

Either the seller or the buyer can prepare a purchase agreement. Like any contract, it can be a standard document that one party uses in the normal course of business or it can be the end result of back-and-forth negotiations. Most often, the buyer's real estate agent will write up and prepare the purchase agreement for a house. Note that agents (not being practicing attorneys themselves) can't create their own contracts. In Florida commonly the parties utilize the Florida Realtors/FloridaBar-ASIS-6 Rev. 10/21/2021. That is an example of a approved form.

Can a landlord terminate a land lease agreement before the agreed-upon term expires?
I recently entered into a land lease agreement to rent a plot of land for my business, with a term of 5 years. However, the landlord has informed me that they want to terminate the lease agreement before the agreed-upon term expires. I am concerned about my rights as a tenant and whether the landlord has the legal authority to terminate the lease prematurely.

Hi there, Generally, a landlord cannot unilaterally terminate a land lease agreement before the end of the agreed-upon term—especially if the lease is for a fixed period like 5 years—unless the lease specifically allows for early termination or you, as the tenant, have violated the lease terms. Here is what you need to know: Understanding Your Rights as a Tenant: Fixed-Term Leases Are Binding Contracts: A 5-year lease creates a legally enforceable agreement. Unless the lease contains an early termination clause, the landlord is bound to honor the full term. Landlord Cannot Terminate Without Cause: If you are in full compliance—paying rent on time and following the lease terms—the landlord typically has no legal authority to terminate the lease early without breaching the agreement. Review the Lease Terms: Carefully review your lease for: Termination clauses Conditions for default or breach Notice requirements These will determine what rights the landlord may—or may not—have. You May Be Entitled to Remedies: If the landlord attempts to terminate without proper grounds, you may be able to: Enforce the lease and stay on the property Seek damages for any losses you incur due to early termination File a legal action for breach of contract, if necessary Early Termination Negotiations (Optional): In some cases, parties can agree to a mutual termination with compensation, but this is entirely voluntary and should benefit both sides. I recommend consulting a real estate attorney to review your lease and protect your rights. If you are operating a business on the property, there could be additional legal protections available to you depending on the nature of the lease and local laws.
