Is it possible to terminate a Real Estate License Agreement before the agreed upon expiration date?

I recently entered into a Real Estate License Agreement with a broker to work as a licensed real estate agent, but due to unforeseen personal circumstances, I am no longer able to continue in this profession and need to terminate the agreement before the agreed upon expiration date. I want to know if it is possible to end the agreement early and if there are any legal implications or penalties associated with doing so.

It is usually possible to get out of a contract for employment (or work as an independent contractor) for these types of reasons (slavery was banned in the US some 150 years ago - no one can force you to work). I suggest that you talk with the broker and ask to get out of your contract. Let him or her know that you can provide a general letter from a health care provider to back up your request based on a health reason making you unable to work and/or fulfill your contract (the letter need not give specifics or otherwise violate your privacy). This could be a bit "trickier" if the broker has invested in you, eg, paid for training, licenses, etc - if that's the case, be prepared for this, and have a counter-offer ready, at least in your head. You will need to use all your negotiation skills - if your health issues may limit your ability to be at your best in such negotiations, you may want to bring in someone to negotiate on your behalf - this does not need to be an attorney. Here's a step-by-step guide on how to draft an NDA that will help safeguard your interests: Understand Your Needs: Clearly identify what specific information you want to protect. This could include trade secrets, business plans, customer lists, product designs, or any other sensitive information. Consult an Attorney: It's highly recommended to consult with an attorney who specializes in intellectual property or contract law. They can provide you with tailored advice and ensure your NDA complies with applicable laws in your jurisdiction. Basic NDA Structure: Title: Start with a clear title such as "Non-Disclosure Agreement" or "Confidentiality Agreement." Parties: Identify the parties involved, including your business and the other party. Recitals or Purpose: Include a brief statement explaining the purpose of the agreement, such as why the parties are entering into it. Definition of Confidential Information: Define what constitutes confidential information. Be as specific as possible to leave no room for ambiguity. Can a freelance contract be terminated by the client without notice?

I recently entered into a freelance contract with a client to provide graphic design services for their marketing campaign. The contract did not specify any notice period for termination by either party. However, after completing a significant portion of the work, the client suddenly terminated the contract without any warning or explanation. I would like to know if they had the right to do so without providing any notice, and if I have any recourse for the work already completed.

If the contract did not specify any notice period for termination, either party can terminate without advance notice. And, yes, there is a way to receive compensation for the work you have already completed - I hope that you kept track of your hours or at least have a way to put a value on the work completed to date. You may want to start with your own letter to the other party (sent in a way that you will get a signed receipt), and, if that doesn't succeed, you can consider Small Claims Court if the value is under $10,000, or Superior Court if the value is over $10,000. Sometimes it's possible to resolve matters through mediation - you may want to propose that to the other party.

Is it legal for a recruiting agency to charge a fee for providing a candidate who was previously referred by another agency?

I recently engaged a recruiting agency to assist in finding a suitable candidate for a position at my company. However, another agency had previously referred a candidate who I ultimately hired through the new agency. Now, the first agency is claiming that they are entitled to a fee for the candidate, even though they did not actively participate in the hiring process. I would like to know if it is legally permissible for the new agency to charge a fee for providing a candidate who was previously referred by another agency.

I'm sorry to hear about what seems like a complicated mess. I suggest that you carefully review the contracts from each agency. The types of questions a contracts attorney would look for would include whether or not you're obligated to the first agency for referring a person and whether or not the second agency may be on the hook to the first agency for referring an employee signed up with the first agency. I'd want to know the time limits for referrals - eg, if the first agency's contract says that you would be obligated to pay them for a hire within "x" amount of time after referring the candidate. To my knowledge, this is the only chapter of Washington State law to review, that is on point: https://app.leg.wa.gov/RCW/default.aspx?cite=19.31 It's often possible to negotiate a settlement in these types of situations. The first agency wants to be paid for their time/effort, which is reasonable, especially if they had a contract with you, but you may be able to settle (if you do, be sure to get everything in writing - that they release you from further liability). If the second agency is somehow at fault, you may be able to get them to reduce the fee they charged you, and/or pay the first agency some or all of the first agency's fee. I hope this has been helpful. Can an employer enforce an IP Assignment Agreement if it was signed after an employee had already started working for the company?

I recently started working for a tech company and was asked to sign an IP Assignment Agreement, which states that any intellectual property I create during my employment belongs to the company. However, I had already been working on a personal project before joining the company, and now I'm concerned that they might try to claim ownership of it. I want to know if the agreement is enforceable, given that it was signed after I had already started working for them.

I hope that you have not yet signed this agreement, because it may indeed be enforceable. If it has not yet been signed, amend the agreement to exclude the personal project from the agreement before you sign it.
