Compromise And Settlement Agreement Templates
As a lawyer with a background in contract drafting and litigation, I created this template settlement agreement to help you formalize a resolution to a legal dispute. Overview of the Template Settlement Agreement
For context, a settlement agreement is typically between two parties whereby one party (the plaintiff) gives up the right to hold the other party (the defendant) legally responsible for current or future injuries, losses, and damages. Settlement agreements are quite common in civil legal matters such as automobile accidents, landlord-tenant disputes, breach of contract claims, etc.
The party waiving their rights do so in exchange for monetary and/or non-monetary compensation.
A settlement agreement may also be referred to as the following:
- Liability release form
- Liability waiver form
- Release of liability waiver
- Release agreement
- Waiver and release of liability
What is Included in the Template Settlement Agreement?
My template settlement agreement contains key provisions to help formalize the terms and expectations associated with the parameters of the settlement. The settlement agreement template expressly states the desires of both parties to settle controversies that might have been raised in a civil action and that the settlement agreement is an effort to avoid such further costs and inconvenience. Importantly, my settlement agreement template states the amount of consideration (i.e., the settlement amount) that will be provided to one party in exchange for them waiving their rights to future injuries, losses, and damages.
My settlement agreement template contains important language highlighting the voluntary nature of the settlement agreement and formally acknowledges that the parties understand the terms and are in agreement with them.
In addition to these sections, my template settlement agreement contains provisions addressing protections afforded to confidential information that may have been shared between the parties during settlement negotiations. There are also provisions discussing tax consequences associated with the settlement, along with representations and warranties between the parties, which helps establish the scope of the settlement agreement.
All of the provisions in my template settlement agreement are modifiable so it can be used to accommodate your unique circumstances. I’ve also included recommended language that can be used to fill in specific sections, such as the terms of settlement compensation.

My template settlement agreement was drafted to be used by individuals, or companies, seeking to resolve a legal dispute through a mutually agreed upon settlement.

My settlement agreement template is appropriate to be used in situations whereby parties embroiled in a legal dispute want to resolve the dispute through an amicable resolution and need to memorialize the terms and conditions of a settlement.
