What is a Pet Agreement?

A pet agreement is the portion of an existing rental agreement that sets the terms and conditions that govern a tenant's pet ownership. The agreement contains details about what breeds are permitted and any additional fees the tenant will incur. Certain rules and regulations are also stated within, such as requiring dogs to remain on a leash while outdoors.

Another major aspect of the pet agreement is the tenant's agreement to abide by state regulations such as licensing requirements. The contract ensures that tenants fully understand and acknowledge the obligations of pet ownership while residing in a rental property. It also gives landlords recourse to take if the tenant doesn't fulfill their obligations.

What's Included in a Pet Agreement?

A typical Pet Agreement should include the following elements:

  • Identification of the Parties: The agreement should clearly identify the pet owner and the pet sitter or pet boarding facility, including their full names, addresses, and other relevant information.
  • Identification of the Pet: The agreement should clearly identify the pet, including the pet's name, breed, age, and any other relevant information.
  • Term of the Agreement: The agreement should specify the start and end dates of the pet care arrangement, and any options for renewal.
  • Care and Custody of the Pet: The agreement should specify the terms and conditions for the care and custody of the pet, including feeding, exercise, and medical care. The agreement should also specify the responsibilities of the pet owner and the pet sitter or pet boarding facility.
  • Payment and Fees: The agreement should specify the amount of payment to be made by the pet owner, the due date, and the method of payment. The agreement should also specify any additional fees, such as fees for medical care or special services.
  • Termination and Return of the Pet: The agreement should specify the circumstances under which the agreement can be terminated, and the process for returning the pet to the pet owner.
  • Liability and Insurance: The agreement should specify the liability of the pet sitter or pet boarding facility for damages to the pet, and the requirement for pet insurance.
  • Governing Law: The agreement should specify the governing law that will be used to interpret and enforce the terms of the agreement.
  • Signatures: The agreement should be signed by both the pet owner and the pet sitter or pet boarding facility to indicate their agreement to the terms and conditions outlined in the document.

PET AGREEMENT

THIS AGREEMENT made on [DATE], between [PET OWNER NAME], with a mailing address of [PET OWNER ADDRESS] (hereinafter referred to as "Pet Owner"), and [PET SITTER/BOARDING FACILITY NAME], with a mailing address of [PET SITTER/BOARDING FACILITY ADDRESS] (hereinafter referred to as "Pet Sitter/Boarding Facility").

WITNESSETH:

WHEREAS, Pet Owner is the owner of [PET NAME], a [PET BREED], [PET AGE] years old; and

WHEREAS, Pet Sitter/Boarding Facility agrees to provide care and custody for [PET NAME];

NOW, THEREFORE, in consideration of the mutual promises and covenants contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

  • Identification of the Parties. Pet Owner and Pet Sitter/Boarding Facility are identified as the parties to this Agreement.
  • Identification of the Pet. [PET NAME] is identified as the pet to this Agreement.
  • Term of the Agreement. The pet care arrangement shall commence on [START DATE] and shall end on [END DATE]. [OPTIONAL: Pet Owner shall have the option to renew the pet care arrangement for an additional [NUMBER] days upon written notice to Pet Sitter/Boarding Facility.]
  • Care and Custody of the Pet. Pet Sitter/Boarding Facility shall provide care and custody for [PET NAME], including [CARE AND CUSTODY RESPONSIBILITIES, SUCH AS FEEDING, EXERCISE, MEDICAL CARE, ETC.]. Pet Owner shall be responsible for [RESPONSIBILITIES OF PET OWNER].
  • Payment and Fees. Pet Owner shall pay [AMOUNT] for the pet care arrangement, due on [DUE DATE]. [OPTIONAL: Pet Owner shall pay an additional [AMOUNT] for [ADDITIONAL FEES, SUCH AS MEDICAL CARE OR SPECIAL SERVICES].]
  • Termination and Return of the Pet. Either party may terminate this Agreement upon [NOTICE PERIOD] days written notice to the other party. Upon termination of this Agreement, Pet Sitter/Boarding Facility shall immediately return [PET NAME] to Pet Owner.
  • Liability and Insurance. Pet Sitter/Boarding Facility shall not be liable for damages to [PET NAME], except in the case of gross negligence or intentional misconduct by Pet Sitter/Boarding Facility. Pet Owner shall obtain and maintain pet insurance for the duration of the pet care arrangement.
  • Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of [STATE].
  • Signatures. This Agreement shall be executed by both Pet Owner and Pet Sitter/Boarding Facility and shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, and assigns.

IN WITNESS WHEREOF, the parties have executed this Agreement on the date first above written.
