What's CAM charge in a commercial lease?
I am currently negotiating a commercial lease for a property where I plan to operate my business. As part of the negotiation process, the landlord has mentioned the concept of a CAM (Common Area Maintenance) charge, which I am unfamiliar with. I would like to seek the advice of a lawyer to better understand what a CAM charge is, what it covers, and what my responsibilities as a tenant would be in relation to this charge.

CAM charges are for common area maintenance. For example, in an office building, CAM charges are for maintaining the lobby, elevators, corridors, and outside areas (such as the parking lot). If you are looking at renting a space, the landlord should be able to provide you with CAM numbers for that space for the past several years, so you know what to expect.

What protection does quitclaim deed offer?
I am the owner of a piece of property that I recently inherited from a family member. I am considering having a quitclaim deed drawn up to transfer ownership of the property to another family member. I would like to know what protection this type of deed offers to both the grantor and grantee in order to ensure that the transfer of ownership is done legally and correctly.

Generally, an owner of property and the potential purchaser would use a Quitclaim Deed when there is no need to warrant or guarantee that the property is free and clear of liens. In other words, the seller does not warrant and guarantee that the property is free and clear of any and all liens. A common use would be when the property has been in the family and the transfer of the property is between family members knowing that there are no liens on the property and all taxes have been paid on the property.

Can I back out of a purchase agreement?
I recently signed a purchase agreement for a house. I was unaware of some major repairs that need to be done and now I am worried that I won't be able to afford them. I am trying to figure out if there is any way I can back out of the purchase agreement and if so, what steps would I need to take.

A well-written purchase offer usually includes several ways for a buyer to back out of the purchase without any penalty - for example, if the buyer doesn't like the inspector's report, one can usually back out on that basis - another typical one is failing to obtain a loan. I hope your buyer's agent wrote up the offer in a way that gave you 2 or 3 "escape clauses" - you should talk with your agent, but if there are problems, I would recommend that you have a real estate attorney review your offer and help you get out of the offer - if possible - with minimal or no cost to you.

When to sign a purchase and sale agreement?
I am in the process of purchasing a property and need to know when I should sign the purchase and sale agreement. I have been given an offer from the seller and have been told that I need to sign the agreement in order to move forward with the purchase. I am concerned about signing the agreement too soon and have questions about the timing and what risks I may be taking if I sign before I am sure I am ready.

If you are not ready to buy a property, it is only fair not to waste sellers’ time who are trying to sell their property. If, however, you are ready to buy a property but is concerned about unforeseeable risks, you can mitigate or eliminate your risks by spelling out contingencies in your Purchase and Sales Agreement. If the conditions or contingencies are not met, you do not have to go through with the deal.
