Commercial Building Lease
California
What's CAM charge in a commercial lease?
I am currently negotiating a commercial lease for a property where I plan to operate my business. As part of the negotiation process, the landlord has mentioned the concept of a CAM (Common Area Maintenance) charge, which I am unfamiliar with. I would like to seek the advice of a lawyer to better understand what a CAM charge is, what it covers, and what my responsibilities as a tenant would be in relation to this charge.
Paul S.
CAM charges are for common area maintenance. For example, in an office building, CAM charges are for maintaining the lobby, elevators, corridors, and outside areas (such as the parking lot). If you are looking at renting a space, the landlord should be able to provide you with CAM numbers for that space for the past several years, so you know what to expect.

Purchase and Sale Agreement
Texas
Does Texas have any specific real estate rules?
I am moving from California and wanted to see if there is anything I should know.
George O.
Like any state, Texas does have rules specific to transactions occurring within its state lines. For example, the Texas Property Code governs most real estate matters, along with Landlord/Tenant matters. However realtors and transactions of that nature are governed by the Texas Occupations Code, which seems odd, but that is how it is.

Co-Ownership Agreement
New York
Need advice on Co-ownership Agreement.
I am considering purchasing a property with a friend and we want to draft a Co-ownership Agreement to outline our rights and responsibilities. However, we have different financial contributions and I want to ensure that my investment is protected in case of any disputes or if one of us wants to sell the property. Can you provide guidance on what should be included in the agreement to address these concerns and any other important aspects we should consider?
Damien B.
Hello. An option is to create an LLC to purchase the property. This would provide liability protection. As part of the LLC, the members would have an Operating Agreement outlining the terms and conditions of managing the LLC (which owns the property), including provisions regarding financial contributions, disbursement, resolutions of disputes or disagreements, and how a property sale would occur.

Agreement To Rent Or Lease
Georgia
what is the best method when it comes to contracts if you plan to do property listing for travelers is there a vast difference between a regular rental contract?
Currently looking into overseeing my parent's rental property and want to make sure we're doing the right process in terms of contracts when it comes to renting out a property whether it is a long-term or short-term.
Darryl S.
Not a VAST difference, but not the same either. You should have a lawyer create an AirBNB or short term rental type agreement and you should not use a standard lease agreement. As examples, the short term agreement might cover check in and out policies, prohibit big parties, etc. and more.

Land Lease Agreement

Can a landlord terminate a land lease agreement before the agreed-upon term expires?
I recently entered into a land lease agreement to rent a plot of land for my business, with a term of 5 years. However, the landlord has informed me that they want to terminate the lease agreement before the agreed-upon term expires. I am concerned about my rights as a tenant and whether the landlord has the legal authority to terminate the lease prematurely.
Jerome L.
Hi there, Generally, a landlord cannot unilaterally terminate a land lease agreement before the end of the agreed-upon term—especially if the lease is for a fixed period like 5 years—unless the lease specifically allows for early termination or you, as the tenant, have violated the lease terms. Here is what you need to know: Understanding Your Rights as a Tenant: Fixed-Term Leases Are Binding Contracts: A 5-year lease creates a legally enforceable agreement. Unless the lease contains an early termination clause, the landlord is bound to honor the full term. Landlord Cannot Terminate Without Cause: If you are in full compliance—paying rent on time and following the lease terms—the landlord typically has no legal authority to terminate the lease early without breaching the agreement. Review the Lease Terms: Carefully review your lease for: Termination clauses Conditions for default or breach Notice requirements These will determine what rights the landlord may—or may not—have. You May Be Entitled to Remedies: If the landlord attempts to terminate without proper grounds, you may be able to: Enforce the lease and stay on the property Seek damages for any losses you incur due to early termination File a legal action for breach of contract, if necessary Early Termination Negotiations (Optional): In some cases, parties can agree to a mutual termination with compensation, but this is entirely voluntary and should benefit both sides. I recommend consulting a real estate attorney to review your lease and protect your rights. If you are operating a business on the property, there could be additional legal protections available to you depending on the nature of the lease and local laws. Feel free to reach out if you would like help reviewing your lease or exploring your options. Best regards, Jerome Lucas Newell, Esq. Real Estate & Business Law Attorney
