Title issues in a purchase and sale agreement?
I am in the process of buying a piece of property, and I am currently in the middle of negotiating the purchase and sale agreement. I am concerned about potential title issues that may arise due to the history of the property, as I am not sure if the seller has clear title to the property. I would like to know what I should look out for in the agreement to ensure that I am protected from any potential title issues.

A typical purchase and sale agreement for real property (commonly called an "Offer to Purchase and Contract" in North Carolina) includes due diligence. Due diligence is the buyer's opportunity to investigate the property. During the due diligence period, the buyer will usually have the property inspected. However, the buyer may also conduct a title search on the property. Additionally, a purchase and sale agreement might specify that the deal is contingent upon the seller being able to deliver clear title to the property. Anyone who is considering entering into a purchase and sale agreement for real property should also consider at least having an attorney review the agreement. It probably would not hurt to have attorney representation throughout the transaction.

Pros and cons of using a quitclaim deed?
I recently inherited a property from a family member, and I am trying to figure out the best way to transfer the title of ownership to me. I have heard of quitclaim deeds, and I am interested in learning more about the benefits and drawbacks of using a quitclaim deed to transfer the title of ownership.

Here are some of the main pros and cons of using a quitclaim deed: Pros: - It's a relatively quick and easy way to transfer property title. The process is simpler than other deed types because no warranty of title is provided. - It can help avoid probate if transferring title from a deceased owner. The property can be transferred without going through probate court. - It's generally less expensive than other deeds. A quitclaim deed is usually considered the simplest and cheapest deed option. - It clears up potential title clouds. It can resolve ambiguities in the property's title history. Cons: - It provides no warranty of title. The person transferring the property does not guarantee they actually own the property. - No liability protection for the recipient. If there are defects in the property title, the recipient has no legal recourse against the grantor. - It may not transfer all interests. Mineral rights, easements, mortgages, and other encumbrances may still exist after the transfer. - The grantor must have valid interest to quitclaim. If the grantor doesn't actually have rights to the property, the deed may be void. - It can facilitate fraud if misused. Care should be taken that the grantor has rights to the property. In summary, a quitclaim deed can be a fast and low-cost option to transfer property title, but provides less protection than other deeds. How enforceable is a quitclaim deed?
I recently inherited a piece of property from a family member and have been told that a quitclaim deed is the only way to transfer the title to my name. I am concerned about the enforceability of this document and would like to understand the potential risks and benefits associated with using a quitclaim deed. I am also curious about the legal requirements for making a quitclaim deed valid.

In theory, any writing in which an owner intends to transfer propery that is adquatedly described and delivered to the transferee is enforcable against the GRANTOR. Thus, a quitclaim deed is generally a valid deed, provided that it has been executed with the requiste formalities for purposes of recording in the public records, and adequetly describes the property. Generally, the term "quitclaim" simply signifies the the grantor does not promise to defend the grantee against any third party title claims. To be properly executed, the deed generally must be executed by the grantor in the presence of the notary, notarized, and signed by the notary and one additional witness. Without meeting these requirements, the deed may not be accepted for recordation in the property records, which also makes the deed "enforceable" against third parties, because it service as notice to those who do not have a previously recorded interest in the property of the grantee's title. In sum, a deed, including a quitclaim deed is generally enforceable against the grantor, but must be executed with the above formalities AND recorded to be "enforceable" against, or serve a notice to third parties of the new owner's interest in the property.

If I am separating with someone I co-own a house with, not married, are there any repercussions to me moving out of the house before we have a signed agreement?
I bought a house with my boyfriend, we are now breaking up. We built the house and moved in in October 2022. It's too soon to sell and make money off of it. I am willing to move out, but I want the cash that I initially put into the house during settlement. We are attempting to come up with an agreement, which I would like an attorney to review before I sign.

Whether there are any repercussions depends upon the circumstances surrounding your purchase. For example, whether or not a mortgage exists can affect the situation. If you are on the mortgage, it would not matter what agreement you sign with your boyfriend, you are still on the hook for the mortgage unless you can negotiate with the lender to remove yourself from the mortgage. It may require your boyfriend to refinance. You are certainly making the right move by having an attorney review any agreement between you and your boyfriend. You just need to consider the third-party lender and how that may also affect you.
