what form would I use to add my spouse to the title deed of my house?
My husband and I bought a house before we got married but he is the only one on the mortgage and title for the home. We are in our 50's now and would like to add myself to the title deed to the home too so we don't run into legal issues if in event that he would pass away before me.

The main form used to transfer property between spouses is called a Quit Claim Deed. This allows you to transfer interest without going through a full real estate transaction. The Quit Claim Deed must be signed by the current owner(s) of the property, notarized, and then filed with the county recorder office where the property is located. There is typically a small filing fee. You will need the full legal description of the property and the Property ID Number or Parcel ID to complete the Quit Claim Deed form properly. This can be found on your current deed, property tax statement, or through the county assessor's office. Both spouses will need valid photo ID when signing the Quit Claim Deed in front of a notary public. If there are already loans secured by the property, the lender may need to provide approval to add the spouse, so check with your mortgage company first.

Can a construction services agreement be terminated by the contractor if the owner fails to make payment within the agreed timeframe?
I recently entered into a construction services agreement with a contractor to renovate my commercial property. The agreement stipulates that I will make payments to the contractor within 30 days of receiving an invoice. However, due to financial constraints, I have been unable to make timely payments and have fallen behind on several invoices. I am concerned that the contractor may terminate the agreement and leave the project unfinished if I am unable to catch up on payments. Can the contractor legally terminate the agreement if I fail to make payment within the agreed timeframe?

Simple answer...Yes. That said, most Owner/Contractor agreements....particularly AIA forms of Owner/Contractor Agreement, empower a contractor to terminate the agreement on written notice following certain work stoppage and cure periods. A more precise answer, in this instance,, would require a review of the relevant provisions of the underlying Owner/Contractor Agreement in question.

What's a 'triple net' in a building lease?
I recently signed a lease for a commercial building and I noticed that there was a clause in it that referred to a 'triple net'. I'm not sure what this means and if it could have any implications for me as the tenant. Can refinancing my mortgage help me save money in the long run?
I am currently considering refinancing my mortgage and would like to know if this option can help me save money in the long run. I purchased my home three years ago and have been making regular mortgage payments since then. However, I recently learned that interest rates have significantly dropped since I obtained my mortgage, and I am wondering if refinancing would allow me to secure a lower interest rate and reduce my monthly mortgage payments. I am also curious to know if there are any potential drawbacks or costs associated with refinancing that I should be aware of before making a decision.

Depending on the rate differential between your current mortgage loan and the refinancing proposal, the saving in the long term can be substantilal. In the short term, the savings in debt service payments will be off-set by the cost of the refinancing, e.g. commitment and loan fees, appraisal and other underwriting costs imposed by a new lender), mortgage title fees and atty fees (taking into account you, the borrower, customarily pays the new lender's atty costs). That said, many residential lenders limit the costs to residential borrowers of the financing costs of any such refinancing),

When to sign a purchase and sale agreement?
I am in the process of purchasing a property and need to know when I should sign the purchase and sale agreement. I have been given an offer from the seller and have been told that I need to sign the agreement in order to move forward with the purchase. I am concerned about signing the agreement too soon and have questions about the timing and what risks I may be taking if I sign before I am sure I am ready.

If you are not ready to buy a property, it is only fair not to waste sellers’ time who are trying to sell their property. If, however, you are ready to buy a property but is concerned about unforeseeable risks, you can mitigate or eliminate your risks by spelling out contingencies in your Purchase and Sales Agreement. If the conditions or contingencies are not met, you do not have to go through with the deal.
