Can a release of lien be obtained without paying off the underlying debt?
I purchased a property that had an existing lien on it, and the seller promised to obtain a release of lien before the closing, but now they are refusing to do so unless I pay off the remaining debt, even though the lien was filed against them, not me - I want to know if it is possible to obtain a release of lien without having to pay off the underlying debt.

The standard practice is that any lien against the property should be paid off at or before closing. You should also have obtained title insurance, which generally covers liens that were not satisfied. You should have received a copy of your title insurance policy sometime after closing, and the lien coverage (or any exception) should appear on the policy. At this point, you should contact an attorney to review all of your closing documents and advise you on the best course of action.

Pros and cons of using a quitclaim deed?
I recently inherited a property from a family member, and I am trying to figure out the best way to transfer the title of ownership to me. I have heard of quitclaim deeds, and I am interested in learning more about the benefits and drawbacks of using a quitclaim deed to transfer the title of ownership.

Here are some of the main pros and cons of using a quitclaim deed: Pros: - It's a relatively quick and easy way to transfer property title. The process is simpler than other deed types because no warranty of title is provided. - It can help avoid probate if transferring title from a deceased owner. The property can be transferred without going through probate court. - It's generally less expensive than other deeds. A quitclaim deed is usually considered the simplest and cheapest deed option. - It clears up potential title clouds. It can resolve ambiguities in the property's title history. Cons: - It provides no warranty of title. The person transferring the property does not guarantee they actually own the property. - No liability protection for the recipient. If there are defects in the property title, the recipient has no legal recourse against the grantor. - It may not transfer all interests. Mineral rights, easements, mortgages, and other encumbrances may still exist after the transfer. - The grantor must have valid interest to quitclaim. If the grantor doesn't actually have rights to the property, the deed may be void. - It can facilitate fraud if misused. Care should be taken that the grantor has rights to the property. What's the property description in a commercial lease?
I am a small business owner who is looking to lease a property for my business. I am currently reviewing a commercial lease and am trying to understand what is included in the property description in the lease. I am hoping to gain more clarity on what the property description entails and how it affects my business.

A property description in a commercial lease has to sufficiently identify the extent and boundaries of the property being leased. For example, it can be described by a map reference or by metes and bounds, or include a description such as "that certain building on the south-westerly corner of California and Larkin Streets." The commercial lease will include defined terms such as "Building," "Property," and "Premises". The defined terms define/describe the "Property" on which the "Building" is located which has the "Premises"/"Space" that is being leased. A sample definition of is Property Description in a Commercial Lease: ""Property" means the real property on which the Building is located together with the Building and all appurtenant fixtures and personal property of Landlord used in the operation of the Building and/or the Property, and any other improvements now existing or hereafter constructed thereon[, including the parking lot, walkways, and landscaped ground as depicted on the site plan attached hereto as Exhibit [LETTER]]."

Can a seller back out of a purchase agreement after accepting an offer?
I recently entered into a purchase agreement to buy a house, and the seller accepted my offer. However, just a few days later, the seller informed me that they have changed their mind and no longer want to sell the property. I have already made arrangements for financing and I am concerned about my rights as a buyer. Can the seller legally back out of the purchase agreement after accepting my offer?

I'm so sorry about this situation! So legally speaking, the answer is no. Under California law, a breach of contract occurs when one party fails to fulfill a legal duty the contract created and causes damages for the plaintiff. (California Civil Jury Instructions Number 303.) The measure of damages is the amount that will compensate the aggrieved party for all the detriment caused thereby or likely to result therefrom. (Cal. Civ. Code § 3300.) You may also seek specific performance of the agreement, too. You have some options you can explore: You can send them a demand for performance or some financial compensation. If you’ve already sent a bunch of letters, then the truth is this is the only way to compel them to do anything. Best of luck!
