Employee or "independent contractor"

Hello, I'm starting a janitorial company. and I'm trying to keep my cost down. as of right now i will be doing all the "cleanings" if i get to over whelm i might need help for one or two gigs which would be 8 hrs or 16 hrs every two weeks if that. so i wanted to see if in California if im able to get help and have them come in as a independent contractor?

Hi there, In California, workers are presumed to be employees UNLESS a company can prove ALL THREE of the following: 1) Control: Worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact; 2) SCOPE: The worker perform work that is outside the usual course of the hiring entity's business; and 3) TRADE: The worker is customarily engaged in an independently established trade, occupation or business of the same nature as that involved in the work performed. AB5 does list occupations that are exempt from the test above but your occupation isn't one of them. I would need more information to give you legal advice but based on your question, you will not likely be able to have them as independent contractors.

Can a Colorado employer change the date of termination on a severance agreement and release notice that says "draft"?

I was recently given a Severance Agreement and Release from my company. My position will end in May. Because the agreement says "draft" and has not been signed, I am unsure if the company can come back with a revised version saying my last day will be sooner.

The short answer is that they probably can. Colorado is an at-will employment state, meaning your employer can generally change the terms of your employment, including your termination date, at any time and for any lawful reason. Since the agreement is marked "draft" and hasn't been signed by either party, there is no binding contract locking in that May end date. That said, this is the general rule. If you have an employment agreement, offer letter, or other written documentation that guarantees a specific termination date or notice period, that could change the analysis. You would want to review any such documents carefully to confirm whether your employer has already committed to specific terms. There are also some important protections worth knowing about in this context: If you are 40 years of age or older and the severance agreement asks you to waive age discrimination claims under the Age Discrimination in Employment Act (ADEA), your employer must comply with the Older Workers Benefit Protection Act (OWBPA). Among other things, the OWBPA requires that you be given at least 21 days to review and consider the agreement before signing, or 45 days if you are being terminated as part of a group layoff or reduction in force. You also get a 7-day revocation period after signing during which you can change your mind. Here is the part that may relate to your question: if your employer makes a material change to the agreement, such as moving up your termination date, the review period starts over. So even if you have been sitting with the draft for a couple of weeks, a revised version with a new termination date would likely give you a fresh 21 or 45 day window to consider the updated terms. ***This response is for general information purposes only and does not constitute legal advice or create an attorney-client relationship. I'm considering taking a second job but would not want my first employer to know. Is there any way for them to find out? I am not sure what all of the language in the contract says and may need to get it reviewed, but I wanted to see if these contracts are kept confidential so that my employer never finds out.

How to track dental associate contracts?

I am a dentist who is looking to hire a dental associate to help with my practice. I need to create a contract that outlines the terms and conditions of the associate's employment, but I want to make sure that I am tracking it properly. It's not necessary to write a contract - you can write a hiring letter with the terms and conditions, with a reminder that the employee is an "at will" employee. This may give you more freedom to discipline or terminate the employee than an employment contract would. However, you can also write this up as a contract. In either instance, do not violate any laws, such as the state and federal laws against discrimination (some counties and cities, such as King and Spokane counties, and Tacoma, Seattle, and possibly Spokane may have additional provisions); watch out for RCW 49.44.211, a 2022 law about nondisclosure and nondisparagement provisions; and, if you choose to include regular evaluations in your letter or contract, the most simple thing is to track those on a calender and remind yourself and your employee of the date a few weeks ahead of time. Some hiring letters and employment contracts provide for reimbursing the employer for the costs of training and/or any costs provided to the employee for moving expenses if the employee leaves before "X" amount of time.. Before hiring any new employee, do your best to conduct a national background check (not just state) and make sure it's extensive - prior performance at another job? Was the work history and education what they say it was? Any misdemeanors or felonies? What is their financial history and credit rating? Etc. Good luck on your hiring decisions.

I have been offered a new job opportunity with a competitor in the same industry, but I am unsure if the non-competition agreement I signed is enforceable. Generally the answers is: it depends. non-compete clauses are falling out of favor in most courts due to the growing restrictive nature of the clauses. It of course depends on your industry, state, and the uniqueness of your position. For example, a non-compete clause in the retail industry saying you cannot work for a competitor store as a customer service representative is likely unenforceable. If you are a highly skilled, trained, and educated wall street stock trader you may be prevented from working for a competitor for a period of time -- but even that is likely not enforcement -- it depends on alot of factors specific to you, the position, the industry, the state, and the acutal contract language. I highly recommend you consult with local employment lawyer in your state to get specific answers to your situation. Good luck.
