Lien
Virginia
Lien on house
Trying to sell home. My title company having issue settling the debt. Title company contact loan to payoff, but no record of my property was found. Only past owner current home is on the loan. Quit Deed was done 2012. In 2015 past owner loan was passed to a different company who record in Florida my parcel number. So basically I can't pay loan off because my home is not attached to her loan. I still can't clear title because lien was recorded 2015 in Fl court house, but The past owner was no longer on deed. Looking to hire a lawyer to clear title, so I can sell my home.
Michael T.
This sounds complicated enough that you need a lawyer to get involved. Do you have a title insurance "owner's policy"? If so, that might get you a free lawyer (I can't tell from the facts you presented whether that will work). Also, you've tagged this question as a Virginia question, but you mention the lien being recorded in Florida. You need an experienced lawyer in the jurisdiction in which the property is located. If the house is in Virginia, you need a Virginia lawyer; if in Florida, you need a Florida lawyer. If it's a lien on Virginia property from a Florida judgment, then you need a Virginia lawyer, because that's where the property is located.

What type of lawyer handles property line disputes
My neighbor's are trying to steal my land
Jerome L.
Hi there, A real estate attorney—specifically one who handles property disputes and boundary line issues—is the right type of lawyer for this matter. I assist clients with these kinds of disputes by helping them understand and assert their legal rights when property boundaries are in question. Here’s how we typically approach a situation like yours: Homeowner’s Plan of Action to Establish Ownership & Defend Property Lines: Obtain the Legal Description of Your Property: Start by reviewing your deed, plat maps, and title documents. These outline the legal boundaries of your property and are critical for defending your claim. Order a Professional Land Survey: A licensed surveyor can physically mark the boundary lines and create a survey report to compare with your legal documents. This is often the first and strongest piece of evidence in a boundary dispute. Review Title History & Any Easements: We will check for any title issues, encroachments, or easements that could affect your rights or provide clarity. Send a Cease-and-Desist or Demand Letter (if appropriate): Before litigation, we may attempt to resolve the matter through a formal letter outlining your legal position and requesting your neighbors stop any encroaching activity. Initiate Quiet Title or Declaratory Judgment Action (if necessary): If your neighbors are asserting ownership or taking aggressive actions, we may file a lawsuit to quiet title or seek a court ruling on the proper boundary. Defend Against Adverse Possession or Encroachment Claims: If your neighbors are claiming rights due to long-term use, we will gather evidence to challenge that, including photos, testimony, and maintenance records. Negotiate a Settlement or Easement Agreement (if desired): Sometimes disputes can be resolved amicably without litigation, through a mutually agreed upon solution. If you are currently experiencing this issue, I would be happy to discuss your situation in more detail during a consultation. We can review your documents and help you take the right steps to protect what is legally yours. Looking forward to helping you secure your land and your peace of mind. Best regards, Jerome Lucas Newell, Esq. Real Estate & Civil Litigation Atto

Property Deed
Texas
How long is a quitclaim deed good for?
Not sure if I am asking the question the right way. We've been asked to file a quitclaim deed.
Melissa L.
A quit claim deed is like a warranty deed for a permanent transfer of ownership to a property after the applicable consideration of payment.

Lease Purchase Agreement
Arizona
Can a seller back out of a Lease Purchase Agreement without providing a reason?
I entered into a Lease Purchase Agreement with a seller for a property, where I agreed to lease the property for a certain period with the option to purchase it at the end of the lease term. However, the seller recently informed me that they have decided not to proceed with the agreement and are backing out, without providing any specific reason for their decision. I had already invested time and money into preparing for the purchase, and I am now concerned about my rights and options in this situation. Can the seller legally back out of the Lease Purchase Agreement without giving a reason, and what recourse do I have?
David U.
Quite simply, the answer depends on exactly what the LPA States either party will or will not do. Ordinarily termination or cancellation rights are expressly spelled out in contracts. This is why it is so important to have an attorney work on your documents rather than just using canned documents available on the Internet.

Release of Lien
Massachusetts
Can a release of lien be obtained if the original lienholder cannot be located?
I recently purchased a property and discovered that there is a lien against it from a previous owner's unpaid contractor. However, I have been unable to locate the original lienholder to request a release of lien. I need to know if it is possible to obtain a release of lien in this situation, and if so, what steps I should take to ensure the lien is cleared from the property's title.
Thomas D.
You have several alternatives. Did your original title policy insure against liens? If so, I can work with the title company to have the lien removed. Second, if the lien is old, it may have already expired and can be removed as a matter of law. Third, there are procedures in every state to remove a lien if the lienholder cannot be located. Finally, we may be able to have the title insurance company insure over the lien. Tom
Quick, user friendly and one of the better ways I've come across to get ahold of lawyers willing to take new clients.
