Contract Agreement

South Carolina

Asked on Feb 1, 2022

I sold my house but was never paid

To avoid foreclosure, I spoke with a contractor to flip my house for me. He would pay my mortgage until it sold then pay it off and keep the profit. I walk away with the mortgage company paid, but I was fouled. He isn't paying the mortgage after I signed the contract. I'm concerned he will be able to sell it now himself without the mortgage company ever being paid.

Christopher B.

Answered Feb 8, 2022

There are many issues involved in this question. I would need to see the original deed and mortgage on your house plus the contract you signed with the contractor. The original mortgage almost certainly had an acceleration clause stating that if you sold the property, then the full mortgage becomes due. Going after the contractor might be possible but other avenues would more likely be the better route to keep your house from being foreclosed. Will also need to see if your contract gives ownership to the contractor or just the right to sell on your behalf. Lots of additional questions that need documents to give you your options.

Employee Separation Agreement

Florida

Asked on Jul 19, 2023

Employee separation agreement and unemployment benefits?

I recently resigned from my job and my employer is asking me to sign a separation agreement. I am concerned that if I sign this agreement, I may not be able to collect unemployment benefits. I need to know if signing this agreement will affect my ability to receive unemployment benefits.

Diane D.

Answered Jul 28, 2023

The only way to answer your question is to have an attorney review the agreement. Not sure why it would stop you from collecting unemployment benefits, but, again, without seeing the agreement, there is no way to answer this question.

Contract For Sale And Purchase

Idaho

Asked on Jun 30, 2022

The difference between Maintenance and Warranty on an RV

We have a contract with a couple that we are leasing to own/rent to own a fifth wheel camper. In the contract it states that we are responsible for all maintenance for the term of the contract. My definition of maintenance is repairs like flooring, hinges, paint, etc. Things we can fix our self's. The issue is the RV has electrical issues, AC going out, Awning separating from RV. These issues require a dealer to fix. Way beyond what we can do. I need to know how to proceed?

Howard B.

Answered Aug 9, 2022

I'm an Oklahoma attorney and not an Idaho attorney, so I am simply providing information about the general theory of contracts. For a more detailed response, you need to talk to an attorney in the place where the contract states for its choice of law. If your contract does not state a choice of law, it is possible the place where you live is not actually the law that applies to the contract. The law of the place where the buyers are located might apply. Typically, the words in a contract are to be interpreted in their usual and customary way and not in any technical way, unless the contract indicates otherwise. So, the dictionary meaning of "maintenance" may well be applied. I see two definitions in Merriam-Webster, both of which are not helpful to you because they are broad, not distinguishing between "maintenance" stuff like replacing brake shoes in a trailer's electric drum brake system and fixing or replacing broken things like an A/C unit that simply died after running non-stop during a heat wave. There may be some case law on this in the correct jurisdiction. Your really need to talk to a local attorney and show them the contract you have.

Employee Confidentiality Agreement

Florida

Asked on Jul 14, 2025

Can an employer enforce a confidentiality agreement after an employee leaves the company?

I recently left my job at a company that required me to sign a confidentiality agreement. The agreement stated that I cannot disclose any confidential information about the company, even after my employment ends. I am now considering starting my own business in a similar industry and I am wondering if my former employer can enforce this confidentiality agreement and prevent me from using any knowledge or information gained during my employment.

Ralph S.

Answered Jul 25, 2025

Agreements often have clauses that survive termination. It would be hard to advise you without seeing the contract. How broad/reasonable the clause is, is there a liquidated damages clause, are they asking for equitable relief, etc. And of course, all these likely involve litigation. And also what is information is confidential as it relates to your new business
