Breach of contract?

I’m a nurse practitioner currently employees under a contract in which I was suppose to receive a bonus paid out 30 days after a 12 month period. One week after the 30 days has passed, the Bonus has not been paid. This is consider breach of contract, correct? the contract stipulates I must give 30 days notice prior to quitting. Does this still apply if he is in breach?

Have you asked about receiving the promised bonus? It may just be late. I would talk to the employer before quitting. And, yes, you must still give the 30 days' notice or you will be in breach. Also, realize, if you quit you may not be entitled to the bonus. I would have to see the contract you signed to actually know what you are entitled to or not.

The offer is significantly lower than expected and does not include the benefits I was expecting. I am unsure of how to handle the situation and would like advice from a lawyer on how to proceed.

One important thing in negotiations like this is that you don't want to let your emotions take over, which will probably lead to you burning a bridge. Even if you were very disappointed in the initial offer, try to stay composed in your communications and just let them know that this is quite a bit below the offer that you were expecting. They will probably say that the offer is more than fair when taking into the market, your qualifications, etc., so it is important that you are prepared with a counter offer and some decent arguments to back up your counter offer. Maybe they mentioned in the hiring process or the job posting that benefits would be included? Maybe you have qualifications that put you above the average market employee in this position? Regardless, employers almost always have some room to move from an initial offer that they make to a prospective employee, so it rarely hurts to ask for a little more.

I am concerned about potential liabilities and obligations that may arise from the agreement if non-monetary terms are included. I would like to know what legal considerations I should take into account when crafting the agreement.

Settlement agreements can contain any provisions that the parties are willing to agree to provided that those provisions are not illegal or against public policy. There are also safe guards that can be included in the language of the agreement so that legally enforceable terms are undisturbed even if part of the agreement may be found to be invalid.

In North Carolina, written employment agreements between medical groups and the physicians that they employ are standard. A reputable group will almost always present a proposed agreement to a prospective employee without being prompted. Sometimes, the proposed agreement is in the form of an "offer letter" that, once signed, will become the contract between the parties. Before signing any proposed agreement, a prospective employee should ensure that it accurately reflects what the parties have agreed to. It should include all of the agreed-upon terms and should be written clearly enough that an outside third party could interpret what the parties intended without seeking further explanation. Additionally, a prospective employee should pay close attention to contract clauses intended to have long-term effects, including but not limited to "restrictive covenants" such as non-disclosure, non-competition, or exclusivity provisions. Last, a prospective employee might consider having an attorney review a proposed employment agreement before signing. Good luck!

What's paid time off in an employment contract?

I am a recent college graduate and I am in the process of negotiating an employment contract with a large company. I am trying to make sure I understand the terms of the contract, including the paid time off that is offered. Paid Time Off (PTO) is essentially days (or even hours) that the employee is not required to work but the employer still pays the employee for those hours. It can be awarded in a lump sum in advance, or earned and accumulated over time, dependent on the terms of the employment agreement. PTO may be granted in addition to or in lieu of vacation days, sick days, etc, again depending on the unique employment agreement.
