I recently left my job at a technology company and signed a non-competition agreement when I started working there. I have been offered a new job opportunity with a competitor in the same industry, but I am unsure if the non-competition agreement I signed is enforceable. I want to know if I can legally take the new job without facing any legal consequences from my previous employer.

Generally the answers is: it depends. non-compete clauses are falling out of favor in most courts due to the growing restrictive nature of the clauses. It of course depends on your industry, state, and the uniqueness of your position. For example, a non-compete clause in the retail industry saying you cannot work for a competitor store as a customer service representative is likely unenforceable. If you are a highly skilled, trained, and educated wall street stock trader you may be prevented from working for a competitor for a period of time -- but even that is likely not enforcement -- it depends on alot of factors specific to you, the position, the industry, the state, and the acutal contract language. I am an employee who is currently in the process of resigning from my current position. I have been offered a separation agreement from my current employer which outlines the terms of my departure. I am looking for clarity on the notice period that must be included in the agreement, as well as any other requirements that must be fulfilled in order to ensure a smooth and compliant transition.

North Carolina is an at-will state, meaning that either party can terminate the work relationship at any time, as long as that termination is not done illegally...for instance, as the result of employment discrimination. If you have a contract with an employer, then you are bound by the terms of the contract. For instance, if the contract states that you must provide 30 days notice prior to termination, then if you don't provide the notice, you could be in breach of the contract. In regards to what must be in the agreement, the employer can't provide false or misleading information. If the employee is over 40, then the employer must provide at least 21 days for the employee to review the agreement under the Older Workers Benefit Protection Act.

I recently accepted a job offer with a new company and I was given an employment contract to sign. I was looking through the contract and noticed that it mentions something about a termination notice. I'm not sure what this means or how it applies to my employment, so I wanted to ask a lawyer to get a better understanding of this clause.

A termination notice is a provision in an employment contract that specifies the amount of notice an employer must give an employee if they wish to terminate the contract, or vice versa if the employee wishes to leave. This is an important clause, as it offers some level of job security for the employee and some level of predictability for the employer. In most states, including North Carolina, employment is considered "at-will" unless there is a contract in place that states otherwise. This means that either the employer or the employee may terminate the employment relationship at any time, for any reason, or for no reason at all, as long as the reason isn't illegal (like discrimination). If your contract includes a termination notice clause, this "at-will" status is likely modified to some extent. The specific details would depend on the exact wording in your contract. It could require either party to provide a notice (often 2 weeks, 1 month, or sometimes longer) before terminating the contract. That notice period is intended to give the other party time to adjust plans accordingly. For the employee, it might mean finding a new job; for the employer, it might mean finding a replacement.

Employee or "independent contractor"

Hello, I'm starting a janitorial company. and I'm trying to keep my cost down. as of right now i will be doing all the "cleanings" if i get to over whelm i might need help for one or two gigs which would be 8 hrs or 16 hrs every two weeks if that. so i wanted to see if in California if im able to get help and have them come in as a independent contractor?

Hi there, In California, workers are presumed to be employees UNLESS a company can prove ALL THREE of the following: 1) Control: Worker is free from the control and direction of the hiring entity in connection with the performance of the work, both under the contract for the performance of the work and in fact; 2) SCOPE: The worker perform work that is outside the usual course of the hiring entity's business; and 3) TRADE: The worker is customarily engaged in an independently established trade, occupation or business of the same nature as that involved in the work performed. AB5 does list occupations that are exempt from the test above but your occupation isn't one of them. I would need more information to give you legal advice but based on your question, you will not likely be able to have them as independent contractors.
