I am a gas station owner and have been leasing the property from a landlord for the past five years. What is the best type of commercial lease?

I am a landlord and am wanting to consider which types of commercial lease agreements I would want to use. I own a small strip mall and am looking to sign tenants that would be retailers.

Much of that depends on the tenant and the agreement they are willing to enter into. Personally, I would want my tenants responsible for as much of the maintenance and upkeep of the property as possible. The same goes with the property taxes. You could calculate out what property taxes are / would be per square foot and allocate to them which will permit you to adjust rent annually to accomodate changes in the property taxes.

Can a landlord add an addendum to a lease without the consent of the tenant?

I recently signed a lease for a commercial property, and now the landlord wants to add an addendum to the lease that includes additional fees and requirements that were not part of our original agreement. I believe that the addendum is unfair and would put an excessive burden on my business. However, the landlord claims that they have the right to make changes to the lease without my consent. I would like to know if the landlord can legally add an addendum to the lease without my agreement, and what options I have to protect my rights as a tenant in this situation.

Generally speaking, one party to any sort of contract cannot amend any sort of contract unilaterally…however, review your lease very carefully to see if you granted the landlord any such rights when you signed your contract—for example, that the landlord could increase the rent if his property taxes or insurance increases.

Hello, I signed a lease for a commercial rental. The owner said that the previous tenant was there for over 20 years and he needed to fix the place. We signed the lease and gave him the deposit, he said that upon completion of the build out he was going to hand us the keys. I needed to buy doors and the handles. I gave him $1500. He said that he would safe the receipts. The build out is completed and he gives me a bill of 5k for things that he "had" to do. He said that the vents were too old, that he had to change the heater and other stuff. When I said no because I was not expecting to pay anything, he sends me a new bill for 12k because I was being unappreciated of the work he did. I need to know my options since I don't have the keys yet and I won't pay something that I didn't know it was needed. Thank you!

It depends on if there was a written agreement or a verbal agreement for your options. Sending a demand letter from an attorney followed by negotiations could help resolve the problem and avoid litigation.
