Can a tenant renew the lease?

I am currently renting a property under a lease agreement that is set to expire soon. I am interested in continuing to rent the property for another term, but I am unsure if I have the legal right to renew the lease or if I need to negotiate a new lease agreement with my landlord. Therefore, I would like to seek the advice of a lawyer to clarify my options for continuing my tenancy.

You need to review your lease agreement. There may be a section that discusses renewal. Some leases are silent, other contemplate automatic renewal and others will have a specific renewal procedure. If your lease has no renewal language, the lease will terminate at the end of the term. If that is the case, you should speak to your landlord about entering into a new lease, whether under the same terms or different terms. If the lease renews automatically, you most likely have to do nothing (if there is a procedure in the automatic renewal language, follow that procedure). If there is a specific procedure to renew, you must follow that procedure. Your lease may also state that if you remain in the property after the lease expires you will be treated as a month-to-month tenant and the terms of your lease (include rent rate) will remain. The landlord or tenant in that case can terminate the month-to-month tenancy with 30 days notice from the date the rent is due. If your rent is due July 1, 2023 and, as a month-to-month tenant, you want to move out, you would notify your landlord in writing on July 1, 2023 that July is the last month you are renting from him and you will be moving out on July 31, 2023. Likewise the landlord can notify you on July 1, 2023 that July is your last month or could change the terms (such as a rent increase) effective August 1, 2023 because the tenancy is month-to-month. There is also the possibility that you would not be considered a month-to-month tenant, but a "holdover tenant". Again, check the lease for these terms. If you are a holdover tenant, the landlord would include in the lease a rental increase for holdover tenants. This is still technically a month-to-month tenancy but on more expensive terms and the landlord most likely will want you out. Check your lease for renewal provisions and follow them. If you have questions, speak to your landlord. Open communication is important in situations like this.

Are there automatic renewals in rental agreements?

I am looking to rent a property and have read the rental agreement, however, I am unsure if there are any automatic renewals in the agreement. I have heard that sometimes rental agreements are set up to automatically renew after a certain period of time, but I am not sure if this is the case with my agreement. I am looking for clarity on whether or not the agreement I am signing includes any automatic renewals.

Do I need witnesses for a rental agreement?

I recently signed a rental agreement with my landlord for a new apartment. I am concerned that the agreement may not be legally binding as there were no witnesses present when I signed it. I am looking for advice on whether or not witnesses are needed for a rental agreement to be legally valid.

Witnesses are not required for a residential lease agreement in Ohio. However, if the term of the lease is 3 years or longer, the signatures must be notarized. I hope this helps.

How To Get an Addendum to a Lease as a Tenant

I'm a tenant with a Case & Associates Property looking to get an addendum made to a lease agreement, specifically about a possible error with the lease term that was signed on. Is this something that can be done between a tenant and property manager? Do I need a tenant lawyer involved? Honestly any help with how to proceed on this is greatly appreciated. The error is that I had wanted to sign on for three months, but got put on for fourth months instead. I believe an addendum could correct this, but am not sure.

You're basically asking for free legal advice because you're not asking for a drafted document but I'll bite because no local lawyer will have a remedy for this anyway. The LL tenant laws for Oklahoma are found in Title 41 of the Oklahoma Statutes. They are very loose. Your proposal could be done, but the PM would have to agree to it. Typically when contracts are altered, there must be a new form of consideration in exchange for the alteration/addendum (unless you're being put on federal military orders which can break any lease.) If you're not going to offer them something of value (i.e. more money, guaranteed professional cleaning of the apt, etc.) they will not have a reason to sign it. If the language of the lease clearly stated 4 months and you signed it anyway, that is on you and you're out of luck. "I wanted to sign on for 3 months but got put on for 4 months instead." Who signed your name without your consent? Were you fraudulently coerced into signing for 1 more month....It sounds like you signed for 4 hoping you could get them down to 3 later...

As a landlord, am I obligated to agree to a demand or a request by a tenant to modify a written lease agreement in order to remove the other tenant from the lease?

Tenants are unmarried couple. The decision to rent was based largely on the man's income. After 1 year of a 2-year lease, she demands to modify the lease to remove him from the lease. I asked for a new application and NTN Decision Point Plus Report. She submits only the application showing her alimony and child support income and social security disability income for her and her 3 children. What are my rights as a landlord with an existing written lease?
