By way of background, a marketing consultant agreement helps establish the terms and conditions between an individual, or company, providing various marketing services and a client. My template can be used to outline your services and payment details for a particular marketing project, or a long-term engagement with a client.
Marketing services that could be described in my template agreement may include any of the following:
- Social media marketing on your client's social media platform (e.g., Instagram, Facebook, TikTok, Twitter/X, etc.)
- Digital marketing (e.g., online newsletters, emails, search engine optimization, etc.)
- Traditional forms of marketing, such as TV and radio advertisements, along with print marketing within magazines, flyers, and newspapers
What is Included in the Template Marketing Consultant Agreement
My template marketing consultant agreement contains all relevant provisions associated with a formal engagement between a marketing professional and a client.
- Engagement of Services: In this section, you can describe the type of marketing services you intend to provide to the client.
- Term and Termination: In this section, you can set forth the duration of the engagement between you and the client, along with a process for terminating the agreement, including termination for convenience, termination for breach, and termination for cause.
- Marketing Consultant's Responsibilities: This section details your role and responsibilities as the marketing consultant. This section can also describe your deliverables and expectations.
- Client's Responsibilities: This section describes what the client needs to do to ensure you can complete your deliverables and meet the stated expectations, such as providing you with all relevant information and materials.
- Compensation Structure: This section describes your fee structure (e.g., hourly, flat fee, etc.), reimbursement protocols for applicable expenses, and payment terms.
In addition to these sections, my template marketing consultant agreement contains modifiable provisions addressing protections afforded to confidential information that may be shared between you and your client, rights associated with intellectual property, representations and warranties, indemnification, and so forth.
