What is a Wedding Agreement?

A wedding agreement is a contract between two people who plan to get married or are recently married that sets the rules for how their property is distributed. The contract is ideal for couples that are wealthy or have a considerable amount of assets to their name prior to the marriage since it protects their assets in the event of a divorce.

Wedding agreements are generally used to eliminate legal problems if the parties file for divorce. This ensures that both parties are treated fairly and aren't stripped of the things they brought into the marriage as a result of the relationship not working out.

What's Included in a Wedding Agreement?

A typical Wedding Agreement should include the following elements:

  • Identification of the Parties: The agreement should clearly identify the parties involved, including their full names, addresses, and other relevant information.
  • Description of Property: The agreement should describe the property and assets of each party, including any real estate, personal property, bank accounts, investments, and debts.
  • Division of Property: The agreement should specify how property and assets will be divided in the event of a divorce or death. This can include a division of property based on the laws of the jurisdiction where the parties reside, or a division of property based on specific terms agreed upon by the parties.
  • Spousal Support: The agreement should specify whether spousal support will be paid in the event of a divorce, and if so, the amount and duration of such support.
  • Waiver of Claims: The agreement should include a waiver of claims to property and assets that are not specifically included in the agreement.
  • Confidentiality: The agreement should include provisions for maintaining the confidentiality of the agreement and any related information.
  • Governing Law: The agreement should specify the governing law that will be used to interpret and enforce the terms of the agreement.
  • Signatures: The agreement should be signed by both parties to indicate their agreement to the terms and conditions outlined in the document.

WEDDING AGREEMENT

THIS AGREEMENT made on [DATE], between [PARTY 1 NAME], with a mailing address of [PARTY 1 ADDRESS] (hereinafter referred to as "Party 1"), and [PARTY 2 NAME], with a mailing address of [PARTY 2 ADDRESS] (hereinafter referred to as "Party 2").

WITNESSETH:

WHEREAS, Party 1 and Party 2 are engaged to be married and desire to enter into this Wedding Agreement to set forth their respective rights and obligations in the event of a divorce or death;

NOW, THEREFORE, in consideration of the mutual promises and covenants contained in this Agreement, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

  • Identification of the Parties. Party 1 and Party 2 are identified as the parties to this Agreement.
  • Description of Property. The parties each represent that they have fully disclosed to each other all property and assets owned by them, including but not limited to real estate, personal property, bank accounts, investments, and debts.
  • Division of Property. In the event of a divorce or death, the parties agree that all property and assets acquired during the marriage shall be divided between them in accordance with the laws of the jurisdiction where they reside. [OPTIONAL: The parties may agree to specific terms for the division of property, such as a 50/50 split.]
  • Spousal Support. [OPTIONAL: The parties agree that in the event of a divorce, Party 1 shall pay to Party 2 spousal support in the amount of [AMOUNT] per month for a period of [NUMBER] years.]
  • Waiver of Claims. The parties hereby waive any and all claims to property and assets not specifically included in this Agreement.
  • Confidentiality. The parties agree to maintain the confidentiality of this Agreement and any related information.
  • Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of [STATE].
  • Signatures. This Agreement shall be executed by both parties and shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, and assigns.
