Trying to sell home. My title company having issue settling the debt. Title company contact loan to payoff, but no record of my property was found. Only past owner current home is on the loan. Quit Deed was done 2012. In 2015 past owner loan was passed to a different company who record in Florida my parcel number. So basically I can't pay loan off because my home is not attached to her loan. I still can't clear title because lien was recorded 2015 in Fl court house, but The past owner was no longer on deed. Looking to hire a lawyer to clear title, so I can sell my home.

This sounds complicated enough that you need a lawyer to get involved. Do you have a title insurance "owner's policy"? If so, that might get you a free lawyer (I can't tell from the facts you presented whether that will work). Also, you've tagged this question as a Virginia question, but you mention the lien being recorded in Florida. You need an experienced lawyer in the jurisdiction in which the property is located. If the house is in Virginia, you need a Virginia lawyer; if in Florida, you need a Florida lawyer. If it's a lien on Virginia property from a Florida judgment, then you need a Virginia lawyer, because that's where the property is located.

Can a real estate option agreement be terminated if the property owner does not fulfill certain conditions within the specified time frame?
I am currently in the process of negotiating a real estate option agreement with a property owner, where I have the right to purchase the property within a certain time frame at a pre-determined price. However, the agreement includes certain conditions that the property owner must fulfill, such as obtaining certain permits or completing renovations, within a specified time period. If the property owner fails to meet these conditions within the given timeframe, can the option agreement be terminated, or do I still have the right to purchase the property at the agreed-upon price? I am seeking clarification on the legal implications of such a situation.

If your option agreement explicitly states that the property owner must meet certain conditions (e.g., obtaining permits or completing renovations) as a prerequisite for you exercising your option, their failure to meet these conditions could render the agreement void or allow you to terminate it. The agreement might include a "time is of the essence" clause, which makes meeting deadlines legally binding. If the property owner misses deadlines for required actions, you may have grounds to terminate the agreement. Carefully examine the terms, particularly sections related to contingencies, conditions, and remedies for non-compliance. Need help with a property issue
My wife and I took over a house from a friend in August of 2008 due to his job transfer from Houston to Nigeria. We agreed to the following terms: We will continue paying the mortgage plus a second loan attached, apply for mortgage approval, and change ownership to our name. We had a written agreement. We applied for a loan in 2009 but was not approved due to poor credit. We decided to wait and continue paying and reducing the outstanding before reapplying. In August of 2021, we reapplied and were given a loan approval to assume the house in our name. Our agent requested that we should have the other party communicate with them. I called and informed him to reach out to our agent but he kept promising to call the agent but never kept his promise. About the middle of January 2022, he stopped picking up our calls. We sent several emails and he never cared to respond. We need help on what to do next.

What are the rights and responsibilities of a tenant in a triple net lease?
As a small business owner, I am considering entering into a triple net lease agreement for a commercial property. I have heard that in a triple net lease, the tenant is responsible for paying not only the rent but also additional expenses such as property taxes, insurance, and maintenance costs. Before signing any agreement, I would like to understand the specific rights and responsibilities I would have as a tenant in a triple net lease, and how these differ from a standard lease agreement.

Hello there! Yes, typically a triple-net ("NNN") lease pushes all of the property (or portion thereof) expenses onto the tenant - essentially as if the tenant was the owner. This differs from a gross lease, where a tenant pays rent only (therefore, the tenant can more accurately predict annual costs). In a NNN lease, it is important for a tenant to (at minimum) be able to estimate how much the NNN expenses will be prior to executing the lease. If a NNN lease is the only option, there are many ways the lease can be revised to mitigate risk for the tenant. I’d be happy to review the lease and suggest such revisions. Thank you!
