Can a new employer ask for my last pay stub?

My company was recently sold but the new company kept the employees. Former won’t hand over our pay information. The new company has requested that we hand in our last pay stub.

The National Labor Relations Act prohibits an employer from engaging in retaliation against two (2) or more employees who band together to for mutual aid and protection, including raising concerns about lack of pay details. See link here: https://www.nlrb.gov/about-nlrb/rights-we-protect/the-law/interfering-with-employee-rights-section-7-8a1 If the company has failed to compensate employees for work, it may be a violation of the Fair Labor Standards Act (FLSA) and/or the Florida Minimum Wage Act (if the employer and employee meet coverage requirements). Florida Whistleblower Act, Fla. Stat. 448.102 provides whistleblower protection for employees who are retaliated for raising certain concerns in the workplace: http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0400-0499/0448/Sections/0448.102.html Finally, if employees have an employment agreement providing pay for their employment, they may have a contractual right to those monies at their pay.

Noncompete agreement geographic scope?

I recently left my job of five years and have been offered a new position with a competitor. The new employer has asked me to sign a noncompete agreement. I am concerned about the geographic scope of the agreement and need to understand what areas it would cover, and if it would prevent me from taking a position with a competitor in another state or country.

The Courts use a reasonableness standard determine if a non-compete is reasonable in time and geographic scope. It would be necessary to see the non-compete to tell you what it says, the areas it would cover and if it would prevent you from taking another position.

Are there caps on damages in settlement agreements?

I am a small business owner who is in the process of settling a dispute with a former employee. The employee is claiming a certain amount of damages, which I believe is excessive. I am interested in finding out if there are any caps on damages that can be included in a settlement agreement, as I would like to come to an agreement that is fair and reasonable for both parties.

In Washington, there are no punitive damages. Employment resolutions are usually based on some percentage or multiple of a person's salary. It is your job to reach a settlement that is fair and reasonable for you, not for a litigant against you (that's their job, not yours). If you are having difficulty resolving this dispute, you may want to consider mediation. Before you pay the employee, be sure to have them sign a full and complete release of all current and future liability and claims against you individually, your business, your heirs; etc. Also, if you have business insurance, it's possible you are entitled to a free attorney to represent you in this dispute.

I am interested in understanding what type of confidentiality is required in this agreement, as I do not want to compromise any of the practice's confidential information. I would like to know what the agreement states about confidentiality and what the consequences are for any breach of confidentiality.

I recently left my job, and my former employer presented me with an Employee Separation Agreement, which includes a non-compete clause. I am concerned about the implications of signing such an agreement and would like to know what my rights are in regards to this clause. I am worried that signing this agreement could limit my future job prospects.

Depending on the scope of the non-compete clause, it could substantially limit your future job prospects. Is the non-compete limited: in time? In industry? In geographical area? To certain competitors? You can certainly negotiate the scope of the clause with your former employer so that your ability to find a similar job is not too restricted. If your employer insists upon a non-compete that is too strict, you should consider whether the severance amount being offered is worth the loss of freedom for your future job hunt.
