Conventional Transfers

If a property is sold, it will be transferred from the seller to the buyer, with the process being determined by the offer to purchase. This type of transfer is known as a conventional property transfer.

Sectional Titles

A sectional title property transfer occurs when a buyer buys a sectional title unit, such as a house that’s located inside a complex.

Deceased Estates

It’s common for a property to be transferred from a deceased person to their heirs, depending on what is included in their will.

It’s worth mentioning that other life events such as divorce can cause the transferring of a property from one spouse to the other. The property will be included in the settlement agreement, but the transfer process will vary depending on whether the spouses were married in or outside of the community of property. The transfer can be conventional or sectional title in nature.

How is a Property Transferred Legally?

There are important legal documents required when transferring a property.

A deed is a legal document that basically transfers ownership rights from one person to another. It’s regarded as proof of transfer.

A deed, which needs to be notarized, contains important information, such as:

  • Property description
  • Signature of person transferring the property
  • Data related to the person who will be taking over the property title

A deed enables you to record a solid title when a property is transferred. If there is missing information in the title, this can put a question mark over property ownership, resulting in issues.

A title search needs to be conducted on the property so that transferring ownership prevents any pitfalls. This search uncovers hidden liens and anything else that could potentially affect the ownership of the property.

How Does a Property Transfer Work?

A property transfer involves various steps. Although these can vary a bit in different states, there are some general guidelines.

Consider the Transfer Terms

There are different reasons why the property is being transferred, and they have different paperwork, fees, and consequences involved. For example, the property can be transferred due to it being:

  • Sold. This transfer will include a purchase offer, sale, and closing date.
  • A gift. This involves tax consequences.
  • Inherited. The property will be mentioned in the deceased’s will. It might require additional costs, such as maintenance expenses.

  • Quitclaim deed. This is common when transferring property to a family member or spouse in the case of divorce.

Any outstanding payments, such as for mortgages, will have to be paid off before the property is successfully transferred.

Sign the Deed

You’ll have to sign the deed and have it notarized. In some U.S. states, you might require witnesses to be present. The deed will be filed with your local clerk.

Payments that need to be made will vary in different states and according to your transfer terms, such as recording fees, gift taxes, or capital gains tax for sellers.
