Noncompete agreement geographic scope?

I recently left my job of five years and have been offered a new position with a competitor. The new employer has asked me to sign a noncompete agreement. I am concerned about the geographic scope of the agreement and need to understand what areas it would cover, and if it would prevent me from taking a position with a competitor in another state or country.

The Courts use a reasonableness standard determine if a non-compete is reasonable in time and geographic scope. It would be necessary to see the non-compete to tell you what it says, the areas it would cover and if it would prevent you from taking another position.

Noncompete agreement and moonlighting?

I am an employee at a company that has recently asked me to sign a noncompete agreement. I am considering doing so, but I am concerned about whether or not the agreement would prevent me from taking on additional freelance work outside of my normal job. I am interested in moonlighting and need to know if a noncompete agreement would limit my ability to do so.

Employment handbook overtime policy?

I recently accepted a new position with a company and was given an employee handbook to review. I was looking over the overtime policy and noticed that it does not appear to be in compliance with the federal and state laws. I am concerned that the policy could leave me in a difficult position if I were to ever be asked to work overtime, so I am looking for advice and guidance from a lawyer to determine if the policy is legally binding.

Private contracts, including employee handbooks, cannot change state and Federal law. So in your case, state and Federal law control, regardless of what your employee handbook says.

Severance agreement and reduction in force?

I recently received a severance agreement from my employer that included a reduction in force. I am unsure of the implications of this, as I am not sure if I am still entitled to benefits or other compensations associated with my former employment. I would like to better understand my rights and responsibilities under the agreement.

I have a question about California severance pay

There is no requirement under California law that a company pay severance to a terminated employee. Your severance pay will be controlled by either your employment agreement or employee handbook. However there are certain things, like paying you your final paycheck immediately that your company will be required to do under California law.
