I need help getting out of a franchise agreement and not paying the upfront fee

I have signed an agreement with nurse next door but that a crisis happened in my life that i had to spend my start up funds for, and now i cant start because i will end up filling for bankruptcy. And i told them this they did not reconsider pulling the agreement i signed when i have not started anything i have not take their training or and did not start doing the home care license and i don't have access to any of there software I just signed so is there a way that i could get out since i have not started anything please i can’t afford this anymore i used to when i signed but life happened

Hi I am sorry to hear about the crisis going on in your personal life. Unfortunately, the best answer I can provide is that "it depends." Once you sign a valid contract, the terms of the contract will likely control how you get out of that contract. Some contracts will have a rescission clause that will let you terminate if done so within a prescribed period of time. Others may have written notice requirements or other actions that are needed before the contract can be terminated. It is tough to tell you exactly how you can terminate your contract without first reviewing it.

Amending a contract, including an independent contractor agreement, usually takes three main steps: First, to amend a contract, the parties must usually agree to new terms. This sometimes requires the parties to negotiate. Second, when the parties to an agreement memorialize it in a written contract, they typically must also sign a written document to amend it. This means that they will need to draft an amendment that accurately reflects the proposed amendment(s). Third, once the parties have drafted an amendment that they are comfortable with, each will sign and will usually receive a signed copy of the fully executed contract amendment. However, note that amending some contracts can be much more complex. For assistance with negotiating or drafting a contract amendment, including for an independent contractor agreement, you should contact a knowledgeable attorney practicing in the appropriate jurisdiction. I have clients all over the world, and routinely have them sign documents of all types (shareholder agreements, board resolutions, merger agreements, etc.) using platforms like Docusign. You should have a simple template that can be used for multiple projects. The key terms to include are: - Contract period - Your specific responsibilities and deliverables - Fees and payment terms - Who owns the work - Non-disclosure clauses - Termination rights (for both parties) if things don't go well - Indemnification (i.e. if something goes wrong, who is responsible for what) This can be a relatively simple contract that can be revised quickly and for multiple clients. One thing to note is that companies will typically prefer to use their own vendor contracts, so you might end up having to review and use their contract instead of yours.

Yes, even though you dont intent to buy the entire business but only the machines and take over the leases (which may be allowed under their current lease or your would have to go directly to the landlord if it is not) you would still need an agreement that lays out what you are buying, the cost, what happens if you have a dispute and all the necessary things to protect your rights.
