Jason is a self-starting, go-getting lawyer who takes a pragmatic approach to helping his clients. He co-founded Fortify Law because he was not satisfied with the traditional approach to providing legal services. He firmly believes that legal costs should be predictable, transparent and value-driven. Jason’s entrepreneurial mindset enables him to better understand his clients’ needs. Before becoming a lawyer, he clerked at the Lewis & Clark Small Business Legal Clinic where he handled a diverse range of legal issues including establishing new businesses, registering trademarks, and drafting contracts. He also spent time working with the in-house team at adidas® where, among other things, he reviewed and negotiated complex agreements and created training materials for employees. He also previously worked with Meriwether Group, a Portland-based business consulting firm focused on accelerating the growth of disruptive consumer brands and facilitating founder exits. Employee contract, such as non compete/non solicit, could having this contract ever result in criminal/jail time?
If someone accuses you of fraud, because they believe you never had intended to honor your employment contract such as non-compete/non-solicit. Could this ever become a criminal case, resulting in criminal/jail time?
Matthew S.
No, at worst, it is a breach of a contract which is a civil matter to be handled in civil court.

Employment handbook vacation policy?
I recently accepted a new job and was given an employee handbook to read over. I read the policies regarding vacation time, but I am unclear about how exactly the policy works and what the process is for taking a vacation. I want to make sure I understand the policy correctly and that I am following the correct procedure for requesting vacation time.
Merry A.
Hello - I am a Washington State employment law attorney. It can often be difficult to understand a policy in an employee handbook. I would suggest two things: (1) Do not ask about the policy or how to interpret it until you have completed at least two months on the job - wait until your supervisor and coworkers get to know you; most likely, you are not eligible for vacation leave until you have been on the job for several months anyway. (2) After two months, ask your supervisor about the policy - not HR. Your supervisor is most likely the person who will have to approve your leave, and he or she will appreciate that you went to him or her instead of going to HR.

When to send a Cease and Desist Letter?
I am a small business owner (retailer), and had a long time staff member (Michael) develop a drinking problem. He felt comfortable enough to come to work intoxicated on a few occasions putting the rest of the staff and my business at risk. He was a supporting manager and had keys to the store. One day he had to be driven home from work because he was too inebriated. Another staff member who drove him to his home gave him a couple of days to come clean to me before she would tell me what happened. He never told me even though i gave him every opportunity to do so. So I had a meeting with him and explained that I was disappointed and wanted to help him, but my business and family had to be protected as well so I took his keys and title away while keeping him employed and at the same pay rate. I did this in hopes that he would get some help and didn't have to worry about being unemployed. Then Covid hit. Had to shut down for a little while. I kept in communication with my team (including Michael) throughout. Everyone responded except Michael. When it was time to re-open I asked everyone to respond letting me know if they were coming back to work. Everyone responded except Michael. Never heard from him again. So, I terminated him under "job abandonment". He then went to work at another local shop, and so I was happy for him and went on with my life and business. A couple of weeks ago I started to get some messages from mutual friends asking me what Michael was posting about on Facebook and other platforms and it turns out he has been posting derogatory comments (all lies) about how we treated him horribly and these could affect my business. None of our staff members can see these posts directly because he has blocked us all. We have, however, been receiving screenshots from mutual friends. Again, this went down over two years ago! I kept him employed I paid him through the pandemic including doing his unemployment paperwork weekly. I didn't fire him. He chose not to come back to work I demoted him and kept him at the same pay rate I tried every way that I could to help him find help I simply want this to stop as I did nothing wrong and did much more than any other employer would have. His parents are enablers and are probably behind this.

Hello, In Georgia, defamation consist of producing a false and defamatory statement about another. Libel consists of writing (via text, social media, or even through a review) a false and malicious defamation of another, expressed in print, writing, pictures, or signs, tending to injure the reputation of the person. Finally, slander of (oral defamation) occurs by making charges against another in reference to his trade, office, or profession, calculated to injure him therein; or uttering any disparaging words productive of special damage which flows naturally therefrom. You can write a letter to your former employee outlining the law and describing how they defamed you and your business. If you have any questions, feel free to reach out to me and set up a consultation. Thanks, Meghan K Thomas, Esq

How to compare multiple employment offers?
I recently received multiple job offers and I'm having difficulty deciding between them. I'm trying to weigh the pros and cons of each offer, and would like to know what considerations should be taken into account when comparing multiple employment offers. I'm concerned about the salary, benefits, vacation time, and job responsibilities, but I'm not sure what other factors I should consider.
Merry A.
Congratulations on receiving multiple job offers. In addition to what you listed as considerations, above, you can review things such as whether these are all for employment (rather than independent contractor); whether you would be considered "at will" or would be given a number of rights as an employee; and whether the employer would provide training/mentorship etc. If I were in your shoes, I'd compare reviews of each employer, as an employer - this can be hard to find, but Glassdoor.com has a limited number of reviews of certain employers. If at all possible, reach out to some current employees at each company and ask the same or similar questions, such as "what do you like or dislike most" about your job and the employer?

Physician employment agreement practice management?
I am a physician who is considering a new employment opportunity and have been presented with a physician employment agreement. I am concerned about the practice management arrangements outlined in the agreement and would like to know more about what is customary in such agreements and what my rights and obligations would be. I am hoping to get some clarity on the practice management arrangements in the agreement so that I can make an informed decision.

Contracts Counsel was incredibly helpful and easy to use. I submitted a project for a lawyer's help within a day I had received over 6 proposals from qualified lawyers. I submitted a bid that works best for my business and we went forward with the project.
