Dispute

Building Lease

North Carolina

Asked on Sep 25, 2021

If you break a lease can a landlord add crazy charges without an agreement?

I signed a lease 9/11 and tried to break it 9/13. Landlord charged me 60 days and did not provide an early termination agreement

Donya G.

Answered Oct 5, 2021

Is there an early termination in the original document that you signed? Typically, you can withdraw from an agreement with minimal fees but it all depends on what your contract states. If you contract does not have any early termination language, you will need a real estate attorney in your state to advise on the law of your state and how to handle. All the best Donya Gordon

Partnership Agreement

New York

Asked on Feb 9, 2022

litigation over partnership

Partner is diverting monies for his own use

Donya G.

Answered Feb 18, 2022

Hello, I am sorry to hear that. Do you have a contract for the partnership? What does it say about resolving disputes? Do you have evidence of the misuse of funds? Can you cut off the funds so that they can no longer misuse the funds? For your safety, please do not confront the partner. All your remedies will depend on your agreement and the state of your business incorporation or where you do business. I see you are in New York. Is that where your business is incorporated? I would love the opportunity to work with you to resolve this. I am an New York contracts attorney who works with clients on contract disputes. I am an Arbitrator and have been a judicial clerk to a Civil Court Judge so I have extensive experience with disputes. When can we get on a call to discuss? I am available later today, Friday 18th or anytime next week. You can connect with me on Contracts Counsel. Looking forward to hearing from and working with you. Sincerely Donya Gordon

Building Loan Agreement

Illinois

Asked on Sep 29, 2022

I brokered a load to a company, they were late , now the office manager wants 4000 $ for a load from a year and 1/2 to be paid, and its a completely differt company. She says the 3 loads wont be delivered til its paid, holding the loads hostage and their is Bulk Mail on the loads, what recourse do I have

I am in loagistics

Donya G.

Answered Nov 9, 2022

The recourse you would have is based in your agreement. Would her actions constitute a breach/breaking of the covenants of the original agreement? If so, then your agreement should also lay out the consequences of such breach. You would need to have the contract reviewed so that you can be advised on what your rights and recourse is based on your agreement. As a contracts dispute attorney with litigation and arbitration experience, I can review your agreement and advise you. You can connect with me directly on the Contracts Counsel website or on my page at Donya Gordon. Thanks Donya
