Depending on the land and business, I'd consider making an LLC for asset protection reasons. Then you could have a trust as the member. If you need to get the property out of your estate, this will dictate what to do with the trust.

Hi, My name is Shawn Mallett. I am a real estate marketer and seller that is not real estate salesperson licensed. Can you confirm whether or not it is legal for me to utilize an option to purchase contract with a seller/wholesaler with the intention to sell and assign the contract (with the seller knowing this intention) rather than the intention to close on it myself? How much would you charge to confirm the legality of the following contract in both PA and NY and make the appropriate changes if needed? Option to Purchase Real Estate Agreement Date: 06/21/2021 This option agreement is entered between the Parties, Optionor(s) and Optionee(s), below in consideration of and subject to the following terms and conditions. 1. Parties ________________ and/or assigns as Optionee and _________________ as Optionor. 2. Property located in the Town of _________, County of _________, state of _________, to wit: Lot: ___________ Grid Number: ____________ 3. Offer: Optionee has the option to purchase this property at a price of __________________. 4. Period: 3 Years (1,095 days) 5. Can I back out of a purchase agreement?

I recently signed a purchase agreement for a house. I was unaware of some major repairs that need to be done and now I am worried that I won't be able to afford them. I am trying to figure out if there is any way I can back out of the purchase agreement and if so, what steps would I need to take.

A well-written purchase offer usually includes several ways for a buyer to back out of the purchase without any penalty - for example, if the buyer doesn't like the inspector's report, one can usually back out on that basis - another typical one is failing to obtain a loan. I hope your buyer's agent wrote up the offer in a way that gave you 2 or 3 "escape clauses" - you should talk with your agent, but if there are problems, I would recommend that you have a real estate attorney review your offer and help you get out of the offer - if possible - with minimal or no cost to you.

Can you purchase or refinance under a land contract?

I’ve been living here for 2 years. Currently have been working with my credit union and they are having a terrible time trying to understand the legalities of my land contract first off, and secondly they just don’t seem to know what they are doing. It’s been over 8 months, 4 different loan officers and I’m once again waiting for someone else to help finish this thing out. It’s only $60,000 with a $120,000 appraisal. So, as of now I am stuck paying 2.5x monthly under this land contract than I was promised would be an easy mortgage process. So any guidance in the right direction would be very helpful. It’s a New York home. 20 yr fixed, no balloon, with a (brace yourself) 12% apr. HELP ME PLEASE! One month I’m being told to authorize a credit check for a first time homebuyer grant method of mortgaging this property. The next it’s authorizing it for a refinance. I do have earnest money deposits for over $3,000 and another $3000 paid towards principal under this land contract also.

A triple net lease designates the tenant (lessee) as having the sole responsibility for any and all costs associated to the asset being leased in the agreement, with those costs being the net real estate taxes on the leased asset, net building insurance, and net common area maintenance. The lease received its name from the three “net” fees and may also be called a Net-Net-Net Lease.
