Vermont Commercial Lease: Types, Key Terms To Know, Costs

Reviewed for legal accuracy by Forest Hamilton JD

Quick Facts — Commercial Lease Lawyers

A Vermont commercial lease agreement is created to rent premises for commercial purposes. Business entities can only use this kind of lease for-profit and a non-profit or charitable group would not be permitted to use one.

A commercial lease is far more intricate than a residential lease. It will frequently be longer than a standard residential lease, impose restrictions on- the use of the land (usually for business or industry), or cover the usage of adjacent units on the site.

Commercial ease may have provisions that hold the tenant liable for more than the payment. A Triple Net (NNN) Lease, in which the renter is responsible for paying the utilities, repairs, and property taxes, is a typical payment structure for a commercial lease. Unlike a net lease, where the tenant is responsible for the rent, a triple net lease has substantially cheaper rent.

Key Elements to Consider for Vermont Commercial Lease

  • Witnesses and acknowledgments are the formal requirements needed for the execution of a Vermont commercial lease.
  • Certain leases with terms of 50 years or more including renewal and extensions and leases that contain the right to purchase and construct a building or make major capital improvements to the property in Vermont are deemed a transfer of title to the property under property tax legislation and are subject to disclosure requirements.

A Commercial Lease should be reviewed even more thoroughly than a residential Lease, with our professional lawyers at ContractsCounsel, due to the increased intricacy of the lease. Additionally, any local and state legislation that can have an impact on the lease should be understood by both parties. What is a commercial lease agreement and how does it work?

I am a business owner interested in renting a commercial space for my business. I am trying to understand the details of a commercial lease agreement and how it works so I can make an informed decision about whether or not to sign a lease. I am looking for information about the terms, conditions, and other relevant details that could affect my business.

MICHAEL B.

Answered Jun 2, 2023

A commercial lease agreement sets out the parameters of the space to be leased, including a description of the premises, an allocation of responsibilities for janitorial services, electrical services, tenant improvements, insurance requirements, payment of rent and payment of common area expenses, parking for employees and visitors, telephone and telecommunication services and many other issues.

What's permitted alterations in a commercial lease?

I am a small business owner looking to rent a commercial space for the first time. I am considering signing a commercial lease and want to know what kind of alterations are allowed in the agreement. I would like to avoid any potential legal issues or disputes in the future by clarifying what is permitted before signing the lease.

Moss S.

Answered Apr 28, 2023

Usually permitted alterations are cosmetic, and non-structural in nature. Often times the Landlord will require the Tenant to submit plans, or in the alternative the lease will describe the fit and finish that would be allowed.

What is a triple net lease?

I want to understand these better.

George O.

Answered May 12, 2021

A triple net lease designates the tenant (lessee) as having the sole responsibility for any and all costs associated to the asset being leased in the agreement, with those costs being the net real estate taxes on the leased asset, net building insurance, and net common area maintenance. The lease received its name from the three “net” fees and may also be called a Net-Net-Net Lease.

Can the tenant make alterations to the property?

I am a tenant of a commercial property and I am interested in making some alterations to the property. I understand that I will need the landlord's permission to make these changes, but I am unsure of what the landlord's policy is regarding tenant alterations and what the legal implications of making such changes might be. I am looking for clarification on the tenant's rights and obligations when making alterations to a commercial lease agreement.

O.T. W.

Answered Apr 14, 2023

Hello! There should be an alterations clause in your lease that speaks to what is or isn't allowed in your space. Your safest bet is to have your landlord review and sign a letter of consent for more substantial improvements (beyond paint, mounting items, etc.)

Can the tenant sublease the property to another business?

I am a business owner and I am looking to rent a commercial space for my business. I am considering signing a commercial lease with the landlord, but I am concerned about my ability to sublease the property to another business. I am trying to determine whether this is an option that is available to me and what the implications would be.

Joseph M.

Answered May 12, 2023

In Massachusetts, a commercial tenant can sublet or even fully assign the unit to a third party - UNLESS there is a specific prohibition in the current lease. However, even if there is such a prohibition, it might still be worth speaking to the landlord about since it might be mutually beneficial.
