Can I work for a competitor with my current noncompete?

I have ended my non competent consulting agreement with my current employee and I have an offer to work as an employer “not as consultant” with a competitor company to my privious employees so can I work as an employee without any problem? The consultant agreement says the following: Under any circumstances the consultant shall not engage directly or indirectly either as a principal agent , consultant,stock holder , partner or in any other capacity whatsoever have any other relationship with any business which compete with the company in USA.

Are non-competes enforceable in California?

I live in CA and work for an east coast company. I have an old employment agreement from ~2006 that has a non-compete clause. Is that enforceable in CA?

No, it's not. California has a very strict law against non-competes, and views those as illegal restraints on trade. Pretty much the only scenario in which a non-compete will be enforceable in California is in connection with the sale of a business.

Employment handbook disciplinary policy?

I am an employee at a large company and I recently received a disciplinary action for an incident that occurred in the workplace. I was given a copy of the company's Employee Handbook, but I am not sure what the disciplinary policy is or what the consequences are for violating the policy. I would like to understand the disciplinary policy so that I can better understand the disciplinary action taken against me.

Review of severance agreement and decision to contest

I am 70 y/o and was laid-off after 3 1/2 years of my employment as a Medical Affairs Senior Liaiason at Lundbeck LLC as part of a company reoganization last week. The company has offered a severance package supposedly based on a Company "Severance Plan" they will make available on request. In the severance agreement, they have listed all of the employees were were considered for elimination with respective ages and which were retained vs eliminated - at least one other person in my age range was eliminated while one was retained - looks like they have covered their bases on issue of age discrimination. Just wondering based on my age and ability to gain comparable re-employment at this point in my life if there is a case for increase in compenstion irrespective of their standard "severance plan" that is in place.

Employment handbook harassment policy?

I am a manager at a company that recently updated its employee handbook. I noticed that the new handbook does not include a policy for harassment, and I am concerned about how to handle such issues in my work environment. I am looking for an attorney to provide advice on the best way to implement a harassment policy and ensure that the policy is compliant with all applicable laws.
