buying a vacant city lot with a quitclaim deed?
hello, i am looking to purchase a vacant city lot in savannah, georgia. it was taken by the city for taxes in 1968 and sold to the current buyers in 1986. seller will only give a quitclaim deed. once i purchase the lot what is the process and cost to get title insurance? regards paul

Paul, Please, please, please purchase the title insurance before purchasing the lot (if possible). This will protect you in the event of any title defects. It is normal for the owner of a lot to prefer to transfer the property via quitclaim deed, especially if the property was obtained via a tax sale. However, it may be extremely helpful to determine, in advance, if there are any title defects which need to be addressed. Are you under contract to sell the property? Does a quitclaim deed give you ownership?

Caveat- I'm a Pennsylvania lawyer. That being said, a quitclaim deed gives you the exact same rights as the party conveying title to you. So if there are liens against the property, for instance, those liens would remain after you take title. Preferably, you would have a title search performed and receive a warranty deed, which would protect you against claims against the property.

Purchase and sale agreement and mediation?
I am in the process of selling my home and have recently received a purchase and sale agreement from the potential buyers. The agreement outlines the terms of the sale but does not include any details regarding mediation in the event of a dispute. I am interested in learning more about the role of mediation in a purchase and sale agreement and what my rights and obligations are in such a situation.

Mediation is a voluntary process that the parties may agree to pursue in the event there is a dispute in an agreement. The parties basically agree that prior to filing suit, or entering into some other kind of process for resolution, they will mediate the dispute. It is a fairly informal process where each party presents its evidence and arguments in a dispute to the mediator, who attempts to work out an agreement between the parties. If it does not result in an agreement, the parties may then go ahead and choose to go to court to reach a resolution of their dispute.

That should work assuming your father isn't responsible on any note associated with the property. If there is a mortgage and note, you'll want to talk with the lender first.
