Introduction to Georgia Labor Laws

Georgia Break Laws
Georgia break laws don’t provide rest or meal breaks to employees. However, employers may offer them as a benefit.
Breaks During Day
Breaks during the day in Georgia aren’t required of employers. However, if they do offer them, then they must be paid.
Hours Allowed to Work
Hours allowed to work before a break don’t apply under federal rules or state statutes. Most employers are scheduling them as a benefit after 4 hours.
Georgia Overtime Laws
Georgia overtime laws provide for wages at a rate of 1.5 times the regular rate for workweeks exceeding 40 hours.

Georgia Wage and Hour Laws
Georgia wage and hour laws address minimum wage, overtime pay, unpaid wages, prevailing wages, and hours in a day employment law issues.
Minimum Wage
The minimum wage in Georgia is $5.15. It’s $7.25 if the employer is subject to the Fair Labor Standards Act (FLSA).
Overtime Pay
Georgia overtime pay is a rate of 1.5 times the regular rate of pay. Salaried employees don’t receive overtime pay.
Unpaid Wages
Unpaid wages in Georgia can lead to a civil claim against the employer after an employee’s resignation or termination.
Hours in Day
Georgia overtime payments for hours in a day don’t apply. An employee must work at least 40 hours a week to receive overtime regardless of hours worked in a day.
Georgia Child Labor Laws
Georgia child labor laws set employment limitations for minors. Children as young as 14 may work. However, restrictions apply to all minor-aged workers, including maximum hours during a school week.

At-Will Employment
Georgia follows an at-will employment legal doctrine. Employees may leave employers without notice. Employers may fire them without notice. Neither party must provide a reason.

Holiday leave in Georgia isn’t a requirement of employers. Employers may choose to extend it as a paid or unpaid benefit.
Sick Leave
Georgia’s sick leave laws allow employees to earn up to 15 days of paid time off each year.
Paid Time Off
Paid time off in Georgia isn’t a required benefit of employers. However, they may offer it as a benefit and used as the employee sees fit.
