Introduction to Florida Labor Laws
Florida recognizes statutes that offer greater protection than federal mandates. Employers need to understand them well to avoid expensive violations of Florida labor laws. If you need personalized legal advice, speak with Florida employment lawyers directly.
Florida Child Labor Laws & Minor Labor Laws
A child 13 years or younger can’t work in Florida with exceptions. If they are aged between 14 and 17, they can perform limited hours and positions.
Florida Overtime Laws
Non-exempt employees must be paid “time-and-a-half” for hours they work over 40 hours per workweek or 10 hours per day. Salaried employees don’t.
Florida Wage and Hour Laws
State and federal employment law statutes govern Florida’s wage and hour laws. They address critical areas of employee pay and time off.
Minimum Wage
The minimum wage in Florida is $8.65/hour. For tipped employees, the minimum wage is $5.63/hour. Florida will raise the minimum wage to $15/hour by 2026. The minimum wage amount must be posted on l abor posters employment contract.
Overtime Pay
Overtime pay in Florida is at least $12.98/hour for each hour of overtime worked. For tipped employees, time-and-a-half pay is $8.45.
Unpaid Wages
Employees can sue employers under the Florida Minimum Wage Act for unpaid wages. They can also ask for liquid, prejudgment, and punitive damages. Employers may hire Florida labor lawyers to defend their case.
Hours in A Day
No limits exist on the daily hours an employee can work. They must be paid overtime for a time above 10 hours. Minors can’t work during school and curfew hours.
Florida Unemployment Laws
No-fault terminations entitle an employee to obtain unemployment benefits. The maximum benefit is $275/week for up to 12 weeks. Employment law terminations for employee violations prohibit them from receiving payments.
Florida Leave Laws & Break Laws
Florida leave laws & break laws give employers flexibility and control over benefits. However, federal and state laws still apply.
Breaks During Day
Minor workers must receive a 30-minute unpaid break every 4hours. No Florida laws on breaks for adult-aged workers exist. Employers may offer unpaid breaks.
Holiday Leave
Employers aren’t required to offer unpaid or paid holidays. You ask them to work on holidays without time-and-a-half pay.
Sick Leave
Florida employers don’t have to offer paid sick leave. However, employees may take up to 12 weeks unpaid under the Family and Medical Leave Act (FMLA).
Jury Duty Leave
Employers can’t prevent, penalize, or fire employees for attending jury duty. However, they’re not required to pay the employee for time missed serving either.
Vacation Leave
Florida employers don’t have to grant employees unpaid or paid vacation leave. Your company can design your policy as you see fit.
