Summary of Florida Wage Laws
Florida wages must meet or exceed federal minimums. While Florida laws emphasize employer flexibility and rights, employees still receive a fair day’s compensation for honest work.
Here is everything you should know about Florida wage laws:
Minimum Wage
On September 30 of each through 2026, Florida’s minimum wage per hour will increase as follows:
- 2021: $10
- 2022 $11
- 2023: $12
- 2024: $13
- 2025: $14
- 2026: $15

Overtime Pay
Overtime pay is for non-exempt employees working over 40 hours per workweek. Manual laborers receive overtime pay for exceeding 10-hour workdays. Florida’s overtime pay rate is $12.98 per hour.
On September 30 of every year until 2026, Florida’s overtime minimum wage per hour will increase as follows:
- 2021: $15
- 2022: $16.50
- 2023: $18
- 2024: $19.50
- 2025: $21
- 2026: $22.50
Commissions Pay
Florida employees face overtime pay exemptions even when considered non-exempt. This rule extends to commission or tip positions. In general, their minimum commissions pay minimum wage.
Back Pay
When owed back pay, Florida employees can seek damages for wage violations. Damages include back pay, liquid damages, punitive damages, and legal fees. Employers may face other civil or criminal actions.
Hazard Pay
Hazard pay is for employees working dangerous jobs. There are no state or federal minimums for hazard pay. Employers aren’t required to pay this benefit but may offer it.
Tips
Tips minimum wage in Florida is $5.63 per hour. Employers must ensure employees receive a regular minimum wage rate in combination with tips. They can also set their own rules around tipping pools.
Severance Pay
Severance pay is not required in Florida when downsizing staff. However, doing so may help companies achieve their attrition objectives faster.
Holiday Pay
Holiday pay is not required in Florida. Employers may choose to offer this benefit to attract and retain human capital.
Merit Pay
Merit pay is a benefit for performance. Recently, teachers received merit pay. However, Florida is still working out the legislation.

Paychecks in Florida must be paid through the following means:

- Check
- Direct deposit
Wage Deduction
Wage deduction laws allow employers to deduct money from employee paychecks for specific reasons, including:
- Property damage
- Past due bills
- Uniforms
- Tools

Unpaid wages allow employees to file claims against Florida employers. Paycheck laws protect their rights to unpaid wages, liquid damages, and punitive damages.
