Florida Holiday Pay Laws Explained

Florida holiday pay isn’t a requirement of employers. However, they can use it as an attractive benefit to attract and retain employees. Employers generally treat holiday pay differently for salaried than they do hourly employees.

What is holiday pay?

Holiday pay is an employee benefit. It comes in the form of overtime pay for hours worked on federal holidays or paid time off.

How much is holiday pay?

Holiday pay is typically 1.5 times the regular rate for hours worked on federal holidays. However, employers can pay employees at the regular rate for hours worked or through paid time off.

Florida holidays

Florida does not recognize state-specific holidays for holiday pay. However, employers can offer holiday pay on Federal or national holidays.

How Does Holiday Pay Work?

Holiday pay works according to the internal policies of Florida companies. They can offer it at the following hourly pay rates for hourly employees:

  1. Regular hourly wage
  2. Time-and-a-half pay
  3. Double time-and-a-half pay

Employer Considerations for Holiday Pay

Employer considerations for holiday pay include how much they should pay and which employees should receive it. Florida holiday pay laws do not require employers to do anything more than reinforce employee agreements.

Time and a half?

Time-and-a-half pay is not a requirement of offering holiday pay. It’s an attractive and easy way to fill work gaps on holidays when employees traditionally use PTO or unpaid time off.

Are employees entitled to Holiday Pay?

Employees are not entitled to holiday pay in Florida. Some employers offer it as a work benefit. You could negotiate it as a condition of your employment as well.

For salaried employees, their wages already include holiday pay. However, exempt employees typically receive time off on federal holidays.

Employer compliance with holiday pay is only necessary when upholding employment agreements. The employer must uphold paid holidays by law under this agreement type.
