Florida Bereavement Leave Explained
Florida bereavement leave is for employees suffering the loss of a loved one, such as a close family member or associate. It’s a time for emotional healing and handling funeral arrangements.

Florida Bereavement Leave Law
Florida bereavement leave laws aren’t set at the state level. Instead, the State of Florida defaults to the Fair Labor Standards Act (FLSA).
Family and Medical Leave Act (FMLA)
FMLA doesn’t provide for bereavement leave. FLSA establishes bereavement leave rules.

Florida limits employee rights for a death in the family. Florida employers determine how they want to offer during this time.

There aren’t bereavement leave eligibility requirements to fulfill at the federal level. Employers decide how they want to handle bereavement leave benefits.

Florida employers must act in good faith when handling time-off requests, even if it’s not an offered benefit. However, you could allow employees to use PTO or sick leave instead.
Bereavement Leave Length
Bereavement leave length is set according to your internal bereavement leave policy and leave payout policy. However, most companies offer up to three days off, paid or unpaid.
Bereavement Leave for Employee
Every employer doesn’t offer bereavement leave for employee benefits. Florida employees should speak with their manager or HR department for more details.
Is Bereavement Leave Paid?
Bereavement leave in Florida is generally unpaid. The only is exception is if you negotiated paid bereavement as a condition of your employment.

The bereavement leave length is up to three days on average. However, employers can offer more or less depending upon their internal policy.
