How to Pay Wages
Florida wage payments can be made through various financial instruments. Under Florida laws, employers may pay wages in the following manner:
- Cash
- Paycheck
- Direct deposit

Minimum Wages
As of January 1, 2021, Florida’s minimum wages are $8.65 an hour. Minimum paycheck laws will increase them incrementally until reaching $15 per hour in 2026.
The following schedule applies to Florida’s minimum wage increase:
- September 30, 2021: $10.00
- September 30, 2022: $11.00
- September 30, 2023: $12.00
- September 30, 2024: $13.00
- September 30, 2025: $14.00
- September 30, 2026: $15.00
Overtime Wages
In Florida, non-exempt employees receive overtime at 1.5 times the regular rate for workweeks exceeding 40 hours. Exempt employees don’t receive overtime wages.
Florida’s overtime minimum wage is $12.98 per hour. Manual laborers must receive overtime pay for workdays exceeding 10 hours.
Direct Deposits
Florida employers can use direct deposit for paying employee payroll wages. Employees should provide written authorization along with their bank account information. It’s unlawful to fire employees for not using direct deposit.
Employee Separation
No specific laws in Florida exist around employee resignations or terminations. However, employer obligations still mean paying earned wages. Final pay doesn’t include accrued vacation pay upon termination unless both parties agreed to those terms.
Wage Disputes
Unpaid wages give employees cause to sue employers. Wage disputes may also include late paycheck and frequency issues. Even if they’re no longer employed, they have the right to back pay, liquid damages, attorneys’ fees, punitive damages, and more.
Wage Deductions
Deduction laws don’t allow employers to make wage deductions in general. However, allowances do exist.
Reasons for wage deductions include:
- Local, state, and federal taxes
- Authorized deductions
- Required uniforms
- Tools and devices for work
- Employer property damage
- Past due bills
- Property theft
If Florida employers make illegal wage deductions, they can face civil and criminal penalties.
Required Notices
Employers must display required Florida Notices at the state and federal level. The U.S. Department of Labor (DOL) executes and enforces this provision.
Federally required notices include:
