Florida Holiday Leave Explained
Florida holiday leave provides flexibility and options to employers. It’s generally offered as an employment condition to attract ideal candidates and retain them for years to come.
Here’s what you need to know about Florida holiday leave:
Florida Public Holidays
Florida public holidays include:
- New Year’s Day: January 1
- Martin Luther King Jr. Day: Third January Monday
- Susan B. Anthony Day: February 15
- Washington’s Birthday: 3rd February Monday
- Good Friday: Friday before Easter
- Pascua Florida: April 2
- Memorial Day: Last May Monday
- Independence Day: July 4
- Labor Day: First September Monday
- Veterans Day: November 11
- Thanksgiving: Last November Thursday
- Christmas Day: December 25
- New Year’s Day: December 31
Employers in Florida don’t have to offer paid holiday leave for any of these days.

Employer Holiday Pay Requirements
Employer holiday pay requirements are limited. Like vacation laws and sick leave laws, labor laws don’t demand that employers offer paid holidays.
Time and a half-holiday pay
Florida employers don’t have to offer time-and-a-half holiday pay. However, they can offer it as an attractive way to fill holiday shifts when other employees traditionally take time off.
Is Holiday Leave Mandatory?
Holiday leave is mandatory if the employer requires it. Holiday pay for holiday leave is not a requirement either.
Holiday Leave vs. Vacation Leave
Holiday leave is different from vacation leave. Holiday leave is for taking time off during major and religious holidays. Vacation leave typically is for taking longer breaks from work.
Employee Holiday Leave
Employee holiday leave is a benefit offered by employers. They can use it to take time off to celebrate national, federal, or religious holidays. However, it’s not a condition of offering it in general.

Florida Holiday Leave vs. Federal Holiday Leave
There are no differences between Florida holiday leave vs. federal holiday leave. The State of Florida allows employees to handle their policies internally. The state also defers to federal regulations under the Fair Labor Standards Act (FLSA).
Fair Labor Standards Act (FLSA)
The FLSA doesn’t require Florida employers to offer paid holidays. However, they may choose to give holidays off as a benefit.
