Florida Paid Overtime Laws Explained

What is considered Paid Overtime?
Paid overtime is mandatory in Florida for workweeks exceeding 40 hours.
How is Paid Overtime Calculated?
Florida employers must pay hourly workers at a rate of 1.5 times the regular rate for each hour of overtime. Salaried employees don’t receive overtime.
Florida Minimum Wage
Florida’s minimum wage is $8.65 per hour worked. This rate increases each year in September as follows:
- 2021: $10
- 2022: $11
- 2023: $12
- 2024: $13
- 2025: $14
- 2026: $15
Florida’s current minimum overtime wage is $12.98 per hour.
Florida Statutes
No Florida statutes exist on overtime pay. Florida paid overtime laws default to federal laws instead.
You must make salary payments or overtime wage payments using cash, direct deposit, or check. Pay cards are unlawful in Florida.

Exemptions from of Paid Overtime

Professional
Professional employees don’t receive paid overtime. Florida enacted the Fair Labor Standards Act (FLSA) standards for professional employees.
Executive
Executive employees don’t receive paid overtime. Florida enacted FLSA standards for executive employees.
Computer Employee
Computer employees don’t receive paid overtime. Florida enacted FLSA standards for computer employees.
Administrative
Administrative employees don’t receive paid overtime. Florida enacted the FLSA standards for administrative employees.

Employer Requirements for Paid Overtime
Employers don’t have to offer overtime to employees. They must only pay employees for hours worked over 40 hours.
