Florida Pay Stub Laws Explained
Florida pay stub laws exist to protect employees and employers alike. From record retention to specific information, these rules ensure that both parties have a legal record of the transaction.

What is a pay stub?
A pay stub, also known as a check stub, is a document issued by employers that details an employee’s earnings and deductions. Pay stubs typically accompany paychecks.
Florida Statutes
Florida statutes don’t exist around pay stub laws. The state doesn’t require employers to provide a pay stub with a paycheck, nor do they have to offer them in electronic format.
Pay stub legislation in Florida instead defaults to federal laws under the Fair Labor Standards Act (FLSA).
Employer Requirements for Pay Stubs
Companies must take employer requirements for pay stubs seriously. These requirements govern both salary payments to exempt workers and hourly wages to hourly workers.
Payroll Records Requirements
Payroll records requirements include fulfilling payroll records requests as well as following Florida payroll record retention rules. Florida employers must retain pay stubs for up to three years from the employee’s last day.
Requesting Copies of Payroll Records
Requesting copies of payroll records is an employee’s right. Florida employers must act in good faith to supply documents upon written request. Non-compliance with these labor laws can result in a non-compliance violation.
