Florida Minimum Wage Laws Explained
Florida minimum wage laws guarantee employees get paid for time worked. It also sets standards regarding minimum rates and employee rights.

Effective January 1, 2021, Florida’s minimum wage is $8.65 per hour. Salaried employees must receive a minimum of $684 per week.

Recent changes to the minimum wage in Florida increases every September through 2026 and capping at $15 as follows:

- 2022: $11
- 2023: $12
- 2024: $13
- 2025: $14
- 2026: $15

Minimum wage laws in Florida are set at the state and federal levels. However, Florida exceeds federal minimum wage standards.

Florida minimum wage laws require employers to pay the current minimum rate. However, they can choose to pay more for skilled positions.
Employers in Florida must also display the 2021 Minimum Wage Poster in a conspicuous location at the worksite.
Fair Labor Standards Act (FLSA)
The Fair Labor Standards Act (FLSA) enforces the federal minimum wage rate. Florida offers employees a higher minimum wage than the federal minimum of $7.25 per hour for hourly employees and $455 per week for salaried employees.

Minimum wage positions generally require little or no previous training or education. They also offer fewer benefits and limit worker control.
Employer Requirements for Minimum Wage
Employer requirements for minimum wage also include recognizing the treatment of non-tipped and tipped employees:
Non-Tipped Employees
Non-tipped employees must receive minimum wage for each hour worked.
Tipped Employees
Tipped employees must receive a minimum wage of $5.63 per hour plus tips, effective January 1, 2021. They also receive wage increases through 2026 and capping at $11.98 per hour plus tips.
