Summary of Florida Child Labor Laws
Florida child labor laws are in place to protect children. In 2021, employers should understand them explicitly. Speak with Florida employment lawyers for questions.
Definition of Child
Florida statutes define a child as any unmarried, unemancipated individual under the age of 18.
Proof of Identity
Employers must maintain proof of identity records for employees under age 17. The information includes a birth certificate, driver’s license, school certificate, or passport photocopies.
Hours of Work
Children cannot work longer than 30 hours per week. They also can’t work between 11 p.m. and 6 a.m.
Age Requirements
No Florida children under the age of 13 are permitted to work, except for family business work.
Prohibited Occupations or Industries
Minor-aged workers in Florida cannot work in dangerous or hazardous occupations or industries.
Minor Work Waiver
Parents can obtain a minor work waiver from DBPR for homeschoolers and children who need to work past state limits. Waivers aren’t necessary for summer breaks.
