Florida Employment & Labor Laws
Florida part-time employment & labor laws default to federal standards. There’s no specific statute in Florida that governs part-time employment relationships.
Employee Rights
Part-time employee rights are similar to full-time employee rights in many ways. Specifically, all employee rights include:
- Right #1: Equal pay for equal work.
- Right #2: Reasonable accommodations for disabilities or religious purposes.
- Right #3: Privacy concerning protected healthcare information.
- Right #4: No discrimination based on race, gender, religion, age, or origin.
- Right #5: Ability to report workplace violations.
Definition of Part-Time
Part-time employees work limited hours. They also have fewer benefits, such as time off, health insurance, and retirement benefits. However, employers may offer these benefits to part-time employees.
Minimum Hours
No minimum hours standard exists under Florida employer & labor laws. Employers may establish internal definitions of what hours part-time employees work.
Employer Obligations & Compliance
Employer obligations & compliance primarily focus on insurance policy requirements. Florida employment labor lawyers can help you determine if you should offer part-time employees working more than 20 hours insurance benefits.
Florida employers can treat part-time employees as they would any other hourly worker. You are free to set their hours, wages and enter into employment agreements with them and vice versa.
Wages for Florida Part-Time Workers
Wages and payments for Florida part-time workers are the same as full-time workers. Florida’s minimum wage is currently $8.65 an hour.
It increases in September of each year through 2026 as follows:
- 2021: $10
- 2022: $11
- 2023: $12
- 2024: $13
- 2025: $14
- 2026: $15
Overtime Rules for Part-Time Workers
Part-time workers occasionally working overtime must receive pay commensurate with the time worked. The Fair Labor Standards Act (FLSA) requires Florida employers to pay an overtime rate of 1.5 times the regular hourly rate.
Unemployment Laws & Part-Time Workers
Unemployment is available to part-time workers so as long as a few conditions are met. You can receive employment in Florida if you:
- Lose your job at no fault to you, and
- Can’t find additional employment, and
- Earned at least $3,400 in the preceding 18 months, and
- Actively seeking employment
