Who do I submit my operating agreement to?

I understand that for a LLC for rental property, liabilty protection, an operating agreement is good. However, once this is completed, what do you do with the agreement to ensure your protected? Does it get filed with the State of the LLC or is it something that can just be filed away at home. It seems it would need to be filed or someone could just change the agreement at home dependent on any situation that came up to protect themselves better which seem like fraud.

The operating agreement is just one of the many things you need to do to show that you are treating this LLC as separate from you personally. With that being said, you will put the operating agreement into a records books with other things like your articles of organization, other government filings, membership ledger, etc. Then keep it at the primary place of business.

Who drafts a demand letter?

I recently received a demand letter from an individual that I had a disagreement with. I am uncertain as to why the letter was sent and what actions I need to take in response. I am looking to understand who drafts a demand letter and what their purpose is in order to determine how to proceed.

Virtually anyone can draft their own demand letter or have an attorney draft one on their behalf, so long as it is not for an unlawful purpose (such as harassment or extortion). The purpose of a demand letter is to "demand" that someone do or not do something. For example, one demand letter might request that the recipient make a payment. For another example, a demand letter might request that the recipient cease and desist defaming the sender. A demand letter should clearly state what the recipient is being asked to do or not do. Often, one that is drafted by an attorney will also state why. A recipient of a demand letter who is unsure about how to proceed should consult with a knowledgeable attorney in the appropriate jurisdiction. The attorney should be able to advise on options for next steps, as well as pros and cons for each. The attorney might also be willing to draft a response or otherwise assist the recipient with resolving the underlying issue.

How can I cancel the signed building repair contract in new york?

I have signed a contract to do repair work of home and it is in the last phase. The contract includes the work to the done and the amount allocated and it does not contain any clauses or date of completion for each phase. Currently, the contractor is not coming for work and not responding to emails and phone calls. 90% of work is done for paid work. No money is paid for pending work. I want to hire a new contractor. Is sending a letter indicating the contract is terminated due to non progress and pending work for paid amount is enough ?

I suggest you send the contractor an email and mail a written letter to him stating that you will not be completing the job with him.

The short answer is yes. As an independent contractor, you bear the risk of profit and loss, employee rules regarding breaks and meals do not apply, nor does the overtime rules.

Do I need to sign every page of a contract?

I am a legal intern and I have a query. Last week I recieved two Service Agreement contracts from two different content agencies. My company has decided to work with them and I was asked by a colleague today that is it important to get signatures on all the pages by both the parties or if they sign the last page is that enough? I was confused and I said get the signatures on the last page of the agreement that will be fine. Today I recieved both the agreements from the agencies and one agency has signed the last page and the other one has signed all the pages.
