What is an Arkansas Employment Contract?
An Arkansas employment contract is a legally binding contract that outlines the rights and obligations of an employer and an employee in a working relationship. This contract will cover terms and conditions relating to the job including:
- Scope of work
- Job duties
- Wages
- Pay schedule
- Duration of employment
- Valid reasons for termination
It is common for employment contracts to also include clauses like employee non-disclosure agreements and employee non-compete agreements. These clauses protect the hiring company by limiting competition and keeping trade secrets confidential.
Are Employment Contracts Enforceable in Arkansas?
Yes. Employment contracts are enforceable in Arkansas. Arkansas follows the laws of at-will employment. This means that employers and employees are both free to end the employment relationship at any time for any reason. The only exception to at-will employment is a properly executed employment contract that defines how and when employment can be terminated.
Arkansas also enforces non-compete agreements and even allows for “blue-penciling” of employment contracts by a court. This means that courts can enforce reasonable aspects of a contract while not enforcing broad or unreasonable terms rather than deeming the entire contract unenforceable.
While some oral contracts can be enforced in Arkansas, it is much better to have all contracts in writing and signed by both parties.
Types of Arkansas Employment Contracts
Some examples of Arkansas employment contracts include:
- Permanent employment. An indefinite contract where an employee is hired to work for a company until the employee no longer wishes to work or the employee is terminated in accordance with the contract provisions.
- Contractor agreement. Used when a company hires an independent contractor for a specific job. The independent contractor is not an employee and the terms and conditions in this contract will differ from permanent employment contracts
- Non-compete agreement. Often a clause in a larger employment contract, this agreement protects the employer’s business interests from competition pursued by an employee
- Non-disclosure agreement. Prevents an employee from disclosing confidential company information after leaving the company.

Can an employer change the terms of employee benefits without providing notice or obtaining consent?
I work for a small company that has recently made some changes to our employee benefits package without any prior notice or consultation with the employees. The changes include reducing the amount of paid time off, increasing the employee contribution for health insurance, and eliminating certain retirement benefits. I am concerned about the legality of these changes and whether the employer has the right to alter the terms of our benefits without providing any notice or obtaining our consent.

If you have an employment contract, the employer must adhere to the terms of that agreement. Similarly, if the company has an employee handbook, changes to benefits must align with the policies outlined therein. Courts may consider an employee handbook as a binding contract if it creates an expectation of certain benefits. If your benefits are guaranteed in a written contract or employee handbook and the employer did not follow proper procedures to make changes, you may have a claim for breach of contract. Employers are generally encouraged to provide clear communication and advance notice of benefit changes to maintain trust and compliance with legal and policy obligations. I have been given a contract that says 'Fixed Term Employment Contract'. How is this different than a normal employment contract? Is there anything I need to consider before signing this?

What's intellectual property in an employment contract?
I recently accepted a job offer that contained an employment contract. The contract states that I will not use any intellectual property of the company without prior written consent. I am unsure what exactly constitutes as intellectual property and would like to get a better understanding of the definition of intellectual property in the context of an employment contract.

But a few of these are going to be most likely available to you. Internal company know-how or “ how we do things here that help us succeed”. Note the words “Confidential Information”. What's personal leave in an employment contract?
I have recently been offered a job, and the employment contract I have been provided with states that I am entitled to personal leave. I am not sure what this is, or what it entitles me to. I would like to know what rights and responsibilities I have regarding personal leave, and what the employer's expectations are of me with regards to this leave.

Personal leave sometimes replaces vacation and sick time. Some employers just give employees time off for whatever reason the employee chooses. To know more about the rights and responsibilities, you should speak to HR at your new employer who will help you with the employer's expectations and your rights under the leave provision in your contract. Also, look at your contract as it may provide insight as to how to implement the leave. When in doubt, speak to HR. Thanks.
